These grammar freaks miss the whole point. This is an issue that has been weighing on Bethlehem, the ZHB and many citizens for an extended period of time. It is an important issue as it affects future decisions.

Try to keep your eye on the ball anon cowards.

I did have some text with this post, but blew it out tonight, while trying to load the opinion. I had no time to re-write the story bc I was on my way to a ZHB meeting.

I could have deleted the post completely, but wanted to get the word out, and the headline accomplished that.

Sometimes, I can break a story. But more often than not, this bog is a complement to what appears in news accounts. It provides a perspective or details that you may not find in the newspaper, but I would recommend anyone to consider the newspaper their primary source. So it would actually defeat the purpose of my blog if people looked only here.

This Judge entered his ruling without knowing or did not even care about the existence of entire transcript of Zoning Hearing on November 29, 2010 for this case. That was a over 4 hours hearing. He thought there were only two hearings (Page 1 of Zito Decision), but actually there were three with two of them are repeat due to lost transcript. If he read all transcripts from both November 29, 2010 and September 8, 2011 carefully, I am sure he will be shocked to find out how many lies Elias Market had presented and what negative effect will be to neighborhood. then the ZHB's decision have to be rejected.

It took Judge Edward Smith three months to release his final decision with detial anlaysis, while it only took Judge Leonard Zito three weeks with 13 pages ruling. What Judge Zito did is a big question that we will never know. Where is the real justice in America?

The justice was not served. There should not be any warehouse and loading docks for diesel tractor trailers to be allowed in any residential districts anywhere in the US according to the law. Elias Market should not be above the law regardless of how much political power or connection the family has. The neighbors are not opposing the existence or operation of the market even though it is nonconforming use. They are opposing its illegal expansion onto adjacent properties with warehouse and loading docks. Elias Market used all the lies to obtain the zoning relief at the initial hearing and zoning hearing board sided with them and screwed up the neighbors. Now the judge just refused to look at new evidences revealed from the remand hearings and sided with the liars again.

You are absolutely correct. The Judge (s) erred and sided on the sides of the people who lie, give contributions, have connections, etc. The ZHB also is skewed to the Elias side. When you see them in the room with the Elias's, you would think they are all related because of all the hugging and hand-shaking that goes on. Isn't the ZHB suppose to be neutral for all the people? WHERE IS THE JUSTICE??? NOT HERE....
