Feds: Pawlowski Deserves 155-188 Month Sentence, Immediate Incarceration

Federal prosecutors filed a 32-page sentencing memo yesterday, seeking 155-188 months of imprisonment for disgraced Allentown Mayor Edwin "Fed Ed" Pawlowski. "The government also recommends that the Court remand defendant Pawlowski to the custody of the U.S. Marshals immediately following the sentencing," writes the U.S. Attorneys. So when Fed Ed faces the music next week, he had best bring along a few pairs of rubber underwear.

Sentencing is scheduled for Wednesday, September 5, 10:00 AM, at the U.S. Courthouse in Allentown.

AUSA Anthony Wzoreck explained what this is all about by quoting Theodore Roosevelt.
"[C]orruption strikes at the foundation of all law. Under our form of Government all authority is vested in the people and by them delegated to those who represent them in official capacity. There can be no offense heavier than that of him in whom sacred trust has been reposed, who sells it for his own gain and enrichment. He is worse than the thief, for the thief robs the individual, while the corrupt official plunders an entire city or State.”
To those who claim Fed Ed never acted out of lucre, Wzoreck responds that " Pawlowski put his private interest – his ambition — ahead of the public’s interest in good government. He systematically corrupted the contracting process in Allentown to serve his personal interests."

Fed Ed's two tragic flaws - the "vaulting ambition" of MacBeth and the hubris of Xerxes. 

I predicted 10-12 years and stand by it.

Now is a time for healing. Vengeance will help no one. We must come together as a community and look to the future. The former Mayor will be sentenced but it must be with compassion and fairness The prosecution will push for a big sentence to prove their legal worth. The judge cannot allow himself to be swayed by this.. A five year sentence with the move for a parole and community service would be a majors step in moving forward.
Let him giveback to the community through service to those in need.

Six months for each of the 47 felony convictions sounds like a compassionate sentence. Trump’s convicted pals should get the same.

For all the folks demanding their pound of Pawlowski flesh while closing their eyes to D.J.Trump and demanding Mueller shut down the investigation.....the Pawlowski/Fleck/Ruchliewicz debacle wasn’t announced until 7/2/15. The investigation had been going on for sometime and did not have the international financial dealings of professional crooks. If you are thirsting to put Pawlowski in jail for 15 years, then Trump and his rogues gallery of villains should never see the light of day again. Ever. What the slime balls from this administration perpetrated have hurt America in unfathomable ways. And I know Trump hasn’t been charged....Yet.

Given that people who kill another can get around the same sentence as proposed for the ex mayor, I think that sentence is too severe.

I was surprised to see how much shorter the prosecution's recommendations were versus the sentencing guidelines given by the Office of Probation and Pretrial services that stated 30 - 600 years. Is it unusual to have such a discrepancy?

Did the judge rule yet on McMahon's motion to dismiss some charges? Will anything besides sentencing happen at the September 5th hearing?

Pawlowski killed the trust in open and honest Goverment in the third largest municipality in Pennsylvania as he violated the law and public decency.
The former mayor is a liar, cheat and conman with zero remorse.
Unrependent criminals who refuse any responsibility for their actions face the consequences of their criminal behavior-in this specific case 47 felony convictions in U.S. Federal Court.

On Sept 5th Ed will be going away for an extended vacation and it won’t be to Key West Florida.
Eagles tickets are not part of the package but the games will be on TV in the day room.
Somewhere a federal prison camp band will be getting a new drummer.

I've always felt 10-15 years and he would be out in 3-5 by applying himself in some positive endeavors at prison. Of course, I thought he should have admitted guilt right off the bat and he might have received a plea bargain that he could already have been serving, maybe 3 years or so. He never has issued an apology or admitted guilt.

7:09am- I agree. Pawlowski didn't benefit from this, other than being re-elected. I still maintain that his biggest mistake was trusting Mike Fleck- who was financially benefitting from this.

There is no parole system for federal prisoners. They can earn about 54 days a year of good time off their sentence and most serve about 85% of the sentence. So, if he gets 10 years he will not be out in 3-5

Pawlowski, Mr & Mrs Pawlowski both, knew precisely who and what Mike Fleck was from jump street.
To suggest that Pawlowski didn’t benefit personally betrays a level of willful ignorance that doesn’t merit a response.
Perhaps you should attend the sentencing and tell Judge Sanchez that Pawlowski didn’t benefit personally.
If you do please report back to us and let us know how you made out.
Fleck and Fed Ed are two peas in a well documented pod.
The testimony is a matter of public record, the jury has come back and the verdict is in- - guilty of 47 felony counts in a United States federal court of law.

Remember, he's one of the most popular politicians in the area and he cruised to reelection while under 56 count indictment. He's certain he did nothing wrong and has lots of supporters. He'll be back in no time.

Monkey Momma, The judge has not ruled yet on the post trial motions, which strike me as mostly frivolous. At the sentencing, I expect to see Fed Ed jailed. As far as the discrepancy between probation and prosecutor, I do not follow federal criminal cases enough to answer you. On the state level, I rarely know what probation is recommending.

SENTENCING GUIDELINES
The United States Probation Department has calculated the defendant=s
sentencing guidelines range as 42-I. The PSI set the base offense level at 4, pursuant to

USSG § 2C1.1(a)(1). The PSI then increased the base offense level based on specific
offense characteristic the Probation Department deemed applicable.
Because more than one bribe was involved, a two-level upward adjustment
is imposed pursuant to § 2C1.1(b)(1).
Because Pawlowski was a public official, a four-level upward adjustment is
imposed pursuant to § 2C1.1(b)(3).
Because the defendant was an organizer or leader of a criminal activity that
involved five or more participants, a four-level upward adjustment is imposed pursuant to
§ 3B1.1(a).
Because the defendant obstructed justice, a two-level upward adjustment is
imposed under §3C1.1.
Because the PSI finds the loss to be more than $1,500,000 but less than
$3,500,000, a 16-level upward adjustment is imposed under §§ 2C1.1(b)(1) and
2B1.1(b)(1)(I).
According to the PSI, a total offense level of 42 with a criminal history
category of I results in a guideline sentencing range of 360 months to life imprisonment.
The PSI states that because the statutorily authorized maximum sentences are less than
the maximum of the applicable guideline range, the guideline range is 360 months to
7,980 months
Under the specific facts of this case, the government and the defendant
disagree with the PSI’s calculation of the loss under §§ 2C1.1(b)(1) and 2B1.1(b)(1)(I).

The government and the defense agree that the loss figure should be $107,749. The
agreed upon loss amount is calculated as follows:
--$13,500 paid by Ramzi Haddad for assistance with zoning.10
--a loss of $18,749 to Johnson Controls as a result of preparing an
RFQ for the Street Lighting contract when the contract was fixed to go to TEN.
--a loss of $35,000 for the CIIBER contract. This contract was
unnecessary for the city of Allentown, and the total value of the contract is an anticipated
loss. Under §2B1.1, Application Note 3, loss is the greater of actual loss or intended
loss.11
--$2,500 in bribes by McTish Kunkle to obtain City of Allentown
contracts.
--a $31,000 loss to Linebarger Goggin Blair as a result of preparing
an RFP for the Delinquent Tax Collection Contract when the contract was rigged to go to
Northeast Revenue.
--a $2,000 loss to Portnoff Law Associates as a result of preparing an
RFP for the Delinquent Tax Collection Contract when the contract was rigged to go to
Northeast Revenue.
--a $5,000 loss to MKSD as a result of their preparing RFPs for the
Pools Contract when the contract was rigged to go to Spillman Farmer.
A loss figure of $107,749 results in an 8-level upward adjustment under
§ 2B1.1(b)(1)(E), which is the range for a loss between $95,000 and $150,000. Finding
an 8-level upward adjustment rather than the PSI calculated 16-level adjustment results in
a sentencing guideline range of 151-188 months imprisonment.

Bernie, as you can see above the difference in the guidelines is do to Value The United States Probation Department did their guidelines on total value of the contracts and the USAO did theirs on total value it believes was lost, which pushes in down the scale. He will be getting a minimum of 155 months or 12.9 years and will serve a minimum of 131.75 months or just shy of 11 years. This will still be the largest sentence ever received by a public official for these crimes.

This is in response to a comment about Ed coming back to office like Marion Barry did in DC.
The PA. Constitution prohibits persons who have been committed of serious crimes from being elected to office. The State Supreme Court interpreted the provision to mean all felonies.

Charlie, York’s mayor has a felony drug conviction from 1991. He was sworn into office in January. I know the DA declined to file a quo warrant. There has been a challenge but I do not know if there has been a ruling.

Rob McCord just received a 30 month sentence. He entered a plea several years ago. The Mayor should get more than that for sure, otherwise how can you encourage plea deals.

The sentencing guidelines are very interesting and helpful to a non-legal mind. Will his complete and utter lack of remorse and responsibility bear upon his sentence? Unless I've missed it, he hasn't owned one bit of his 47 convictions. Is this an appeals strategy? Any thoughts?

Mayor McSqueeze has to express some contrition in the courtroom or the judge should throw the book at him. He will be appealing the verdict anyway. So show no mercy to a slimy politician who has not a iota of guilt for transgressions.

Just because you are convicted of a federal crime in Pennsylvania doesn’t mean that’s where you’ll serve your sentence. Unlike state sentences, the feds will move you around from one institution to another as a needed I would much rather do county or state time then federal. I think Scott Allison is trying to stay in LCJ for as long as possible to avoid the dreaded fed bus tour. They move you constantly
