Big Brother in Pa.: Red Lion Woman Cited For Leisurely Drive

Benjamin Franklin once warned, "Those who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety. And so it has come to pass here in Pennsylvania. Anita Shaffer, a 19 year old Red Lion woman, was stopped and cited by state troopers on March 29 because she dared go on a Sunday drive. A citation was issued March 30.

She supposedly was stopped because her tail light was out, and cited for violating Governor Tom Wolf's shelter-in-place order. Once she returned home, she and her father checked the car she was driving, and were unable to locate this mysterious burned-out tail light. Her father told Pennlive, "There’s a fine line here but at the same time, we still have some freedom, some rights and liberties and we’re allowed to operate our cars. We’re allowed to go for a walk. We’re allowed to go to the park ... ."

Big Brother is watching you.

For your own good.

From William Shirer's best-selling book, The Rise and Fall of the Third Reich:

The SS officer Werner Best, one-time head of legal affairs in the Gestapo, summed up this policy by saying, "As long as the police carries out the will of the leadership, it is acting legally".

Wouldn't we all like to take a leisurely drive but we don't. Cry me a river because some woman decided she can't abide by what the rest of us are doing. Stay home.

The woman was maintaining 6 ft. distance and was in no danger of harming anyone until she was stopped. A total overreach.

and she violated the 1958 law.
guess the rule of law only applies to other people.
or is the rule of law optional?
Until a court rules the police action unconstitutional obey the law or suffer the consequences for violating it.
BTW where were the Constitution warriors on this law before this week?
It has only on the books since 1958 and they never noticed it until now ?

If her car has a cabin filter, maybe she can claim her whole car qualifies as a respirator.

On a related subject, according to the Morning Call, PennDot restarting road construction with cases still increasing. Could it be that scientists determined that killer gas pump handles and porta johns not a big contributor?

The evidence on the ground does NOT support the level of pressures on personal freedom and liberty. Too many average citizens, as opposed to politicians and their puppet masters, have had time to gather their OWN evidence.

The narrative being put out by the WHO, CDC, and most of the corporate news media is confusing, and now beginning to crumble.

Evidence of “EASING” the oppressive grip of big government needs to be seen within the next 7-10 days.

She can win this, it looks like just another revenue increasing act. People are out all the time , she is protected from others by her car. she should sue , because the officer put her at risk by making her open her window.

as long as 10 penn dot workers stand 6 ft apart while they watch the one guy fix the pot hole they should be ok

The most glaring and troublesome flaw in how this crisis is being presented comes during the official press conferences. We are shown charts and graphs by Fauci and Brix. But NOT IN CONTEXT of what a typical representation due to illness of a similar type, at any other time, would look like in comparison.

Example, The CDC and related websites reveal charts and graphs for specific illness occurrence and outbreaks. One for PNEUMONIA. A pneumonia ‘curve’ placed over a COVID-19 curve, reveals a dramatic drop in pneumonia number of deaths, while the numbers of deaths due to COVID-19 rise.

The way deaths are being CODED as due to COVID-19, rather than something else, must be considered as an influence upon today’s charts and graphs.

Charts and graphs, like political polls, can be misleading due to the input data. As Bernie pointed out, comparisons to Italy, Spain, and other places are not guarantees of what will happen in America. They produce their OWN charts!

Read the frickin' exec order. Nowhere does it say a person is unable to take a drive. And if Wolf amended his order to include such a provision, I would defy it,

I just heard some asshole on WLVR-FM say that, if you go outside to exercise, you must be masked bc of the Governor's order. That is misinformation. It is recommended you wear a mask but it is not required. There is no such order. If there is, Wolf should arrest himself bc he did not wear one when recommending that we all do so.

Jondar said...

Seems to me that going for a drive certainly qualifies as an outdoor activity, and if alone in the car, also meets the social distancing criteria.

However, none of that should even apply, as it looks like the citation claims she violated the order of 3/19, which is NOT the stay-at-home order, but rather the essential business order.

Should be tossed in a heartbeat.

If proven true that her tail light wasn't broken, that officer should be suspended without pay.

This is sick and disturbing. Don't tell me cops already have enough to do when they're doing this nonsense. They clearly have a lot of time on their hands and are cashing in on OT.

Re: radio commentator’s remark on being masked while exercising outside.

It would really be nice to have a medical or physical fitness person with real credentials chime in on this subject (and maybe inform the Governor’s office). I’m not a doctor and I don’t play one on TV, but this sounds like a really dumb idea - reduced oxygen intake, overheating, etc.

I will NOT criticize police officers out on the street. They are being forced into carrying out regulations they did not write, and probably do not approve of. Some officers will use better judgment and issue warnings in most circumstances. Others will not.

I may have missed the time of day this occurred. Sorry. But during the stop, the Troopers in car camera should have been activated once he turned on his overhead emergency lights. Also, body cam footage as he approached the vehicle could possibly show the tail light was not operating.
Let's see if dad needs to offer a sincere public apology or the trooper faces discipline.
Either way, should we ALL go out driving around????? More vehicle crashes. Even a minor crash causes face to face interaction, the handling of documents between the parties and possibly law enforcement.
Good idea. LET's DO IT!!!!!!!!!!!!!!!!!!1111
But its OK to violate the 2nd Amendment during the virus across the country.

PSP and many LE agencies are known to "pinch" people when the stop is questionable but the driver doesn't comply or back sasses. That's what this seems like. While the Troopers know its BS, the driver now needs to spend time and resources to get the ticket dismissed or reduced. She may have to hire a lawyer. She may not and roll the dice at the DM hearing. It is very likely the Trooper will not even show at the hearing and the ticket dismissed. A lesson was taught by the PSP I guess.

The stop was wrong, and the fine was wrong.

If the young driver had thought of it, she should have played PC Poker and said she had a disability that kept her from getting out and exercising, or that she had lost her emotional-support groundhog and was out trying to find it.

Then she could have sued the Governor/state for that violation of her rights as well.

I'll bite.. how is the second amendment being violated. I need to renew my carry permit, but our Governor extended the time period and gun shops are open.

However, Mr. Construction, you seem to have no problem with our 4th amendment.

Boy, if that tail light wasn’t really out, this is going to be one really big “you mean they were lying?” story.

https://www.msn.com/en-us/news/us/you-won-t-get-pulled-over-for-driving-during-stay-at-home-order-in-pa-police-say/ar-BB11YEMy

And for those not of the ovine persuasion who actually want to think about the legal aspects, this is pretty clear reading.

Personally, not a big fan of “lawyering up,” but sometimes organizations, businesses, and governments just have to pay a “stupidity tax,” although when it comes to government, we end up paying it.

This is such a slippery slope. Since 9/11, we have willingly sacrificed so many of our liberties in the name of security. In an effort to get a gas discount or a free ham for Easter, we scan a discount card at the grocery store which then tracks our purchases, yet we're fine with that because we get 10 cents off a gallon of gas. I don't know if we are ignorant or lazy -- or a dangerous combination of the two. It is sad that we are a people who no longer want to ask questions and rock the boat.

I never said the law stated she couldn't take a drive. I was noting that most of us aren't taking leisurely drives, because we've been asked not to. Otherwise, everybody would be out and about.
And of course you would defy such a provision if it existed. Nobody expects less of you.

And, if your governor told you wolverines made good house pets, would you believe him?

Silly government. Driving is essential to procuring out of state liquor and Governor Wolf waved the green flag for PA's new bootleggers. I scored NY hooch in a dead drop on Thursday and simply made the drive to NJ with gloves and clorox wipes. The Jersey store ran a very safe and smooth social distancing operation. It's a shame PA can't figure that out. I guess there's no incentive when you're home on vacation. PLCB's panic-demic response should certainly lead consumers to demand the abolition of state stores.

Anonymous said...

The Gov.'s order is in place to protect us. If she challenges its constitutionality, the prosecution presumably will cite the order of the PA Supreme Court that upholds it. If she challenges probable cause for the stop, the judge doesn't have to believe her.

I have read bloggers on this site who said they'd lie to cops about their purpose in driving, as in "My grocery store happens to be in the Poconos".

Stay the hell home.

GOOD NEWS !

The CDC’s estimated number of deaths attributed to COVID-19 continue to be adjusted DOWN. Repeat, DOWN. At the moment, that total number is only a little higher than a strong, seasonal FLU !

We can discuss many reasons why this reduction is happening, and LOCAL conditions can vary greatly. However, keeping all of America under lock and key for too many more weeks is, maybe, not necessary. IN MY OPINION!

Anonymous said...

PA 12,980 cases, 162 deaths.

Anonymous said...

The death toll is, and will continue to, tell the story.

Anonymous said...

This plague had already killed 0.001265625% of PA's population. That's TWELVE THOUSANDTHS OF ONE PERCENT gone. The science is real. This is devastating. Lock everything the hell down and arrest violators! This is serious or something.

I am no fan of Joshua Prince, but he has had considerable success in gun cases. His arguments have made law. Your anonymous smear says a lot about you, not him. The case he lost was on a 4-3 decision, and Wolf changed course on the gun issue bc he knew he had a loser if it went beyond the state.

reading prince's lawsuit he admitted the Gov had the power to shutdown gun shops under a 1976 law.
https://princelaw.files.wordpress.com/2020/03/filed-application-for-extraordinary-relief.pdf
He called it unconstitutional.
He is correct but that begs a question.
So where was he from 1976 until filing the recent lawsuit?
If he did not know about that law one would think he was sloppy at the very least.
And if he did know well that tells me he lacked the fortitude to file suit.
prince most likely filed the suit to get his name in the papers, and for groups that wanted to fund raise off the complaint.
So when prince claims to be such a staunch defender of rights i tend to doubt him.

He has been filing and winning lawsuits and making law. I am no fan of the guy and disagree with many of his positions, but you have no idea what you are talking about.
