“Such actions are hauntingly reminiscent of those of a police state, calling to mind the actions of a secret or state police. Actions such as these are a clear violation of basic human rights. This is not the America created by the Framers of the Constitution.
“We call upon law enforcement agencies, local governments, and court administration to prevent the access of ICE agents into courthouses, and to act to protect the rights of individuals lawfully within those facilities from harassment or arrest by ICE agents, whether uniformed or not.”
This behavior is repugnant to many lawyers because it's completely contrary to an ancient common-law privilege from arrest while at a courthouse, or going to or returning from a courthouse. This privilege is called eundo et redeundo. No less an authority than the United States Supreme Court has ruled that "witnesses, suitors, and their attorneys, while in attendance in connection with the conduct of one suit are immune from service of process in another.”
Though the common law has been abolished, courts have the inherent power to protect those summoned to appear before them.

Yawn, still as meaningless as McClowns paper to the Feds.
You misspelled "he was here illegally and visiting the courthouse because he compounded his illegal status by driving drunk and endangering us and our children." There. Fixed it for you. Philly is a cesspool. Lawyers helped make it that way. Most of us regular citizens have had enough.
You do the crime you do the time.
Thank you for fixing, 6:16AM
I'm not surprised. The District Attorney believes crime should be legal in Philly.
So, enforcing the law is now being a police state. why not pass legislation that allows anyone at any time to migrate to the U.S. and become a citizen. that is the goal here.
I guess it is all Okay until one of these people hurt your family or friend.. then it is a different story.. Why should an illegal be treated different then a CITIZEN. Sneak into China? Iran? or alot of countries and see what they do to you.
And you'd like us to be just like China, Iran and "alot" [sic] of countries.
Under ICE guidance, you don't pick up a first offender DUI. You should be out looking for gang members, but that might require real work for a lazy agent.
The practice of courthouse arrests serves to dissuade certain groups of crime victims from seeking police or court protection. Think of a woman who won't ask for a domestic violence protective order if she fears a citizen-check by the Assistant DA. Criminals prey upon immigrant communities because the undocumented fear drawing attention to themselves from the authorities. That's because some of these immigrants actually recognize a police state.
It's sad to read that a huge amount of "American citizens" have little or no knowledge of the Due Process.
LAWYERS=LEGALIZED CRIMINALS . THEY DO ANYTHING TO PROTECT THE GUITLY AND ILLEGALS AND SCREW THY NEIGHBOR. SHOULD BE USA FIRST.
To arrest a human in a courthouse such as was done and, obviously orchestrated, was certainly ill-advised. It was a wrong move on the part of the agent for a multitude of reasons. The statement put out by the Philly Bar Association is inflammatory and hyperbolic.
“…prevent the access of ICE agents into courthouses…”
Attempting to physically prevent federal agents from entering a county courthouse could be quite problematic and divisive. Making policy and/or basing a principle on the emotion which comes from a single, albeit, highly publicized, incident, which never should have occurred, is not wise. IMHO.
The common law has been largely codified, but it has NOT been abolished.
"And you'd like us to be just like China, Iran and "alot" [sic] of countries."
Oh, give it a rest you hyperbolic drama queen. We accept 1.5 million legal souls every year. But in the midst of defending a post that went over like a fart in church, you compare those who peed on your post to communists and radical mullahs. This is why you can't be taken seriously on these issues. The era of Trump has made you sound as stupid as the zealots who defend him.
That's why slick Eddy our illustrious past governor wants to set up shooting galleries with federally funded grants! He thinks shooting up heroin is legal as long as the government funds these fine establishments for the democrats zombie voting base?
Enough talk...maybe they should arrest one of these federal agents while they are attempting to do their duties where they aren't wanted? How do you think that would go?

" they should arrest one of these federal agents "
And if a judge holds the ICE agent in contempt of court?
saying the fed is disrupting his little fiefdom?
good luck getting a higher court overturning that little item.
Also when a fed knocks on your door and has no warrant what is the standard response?
GTFO.
The feds have lost big time in court for not producing a warrant.
What happens when ICE grabs a citizen who has the same name?
They have stepped on their crank before like that.
Another illegal child molester released on the streets of NY to offend again he was working and had a NY drivers license as well as his democrat voter registration?
Anon 8:34 The Feds would promptly arrest anyone who would obstruct them. Ask the Judge in NY how that worked out for her. There is NO local or state court that has jurisdiction over federal laws and a federal agent doing their duties bestowed upon them by congress. You don't like the law, get it changed. LOL

when the judge holds the ICE thug in contempt that officer is subject to that judge's whim.
the thug gets held in contempt for not having the proper attire.
Also this thug did not produce the warrant.that alone could keep him out of the building.
under your scenario anytime the feds want to go rooting thru your home they can just do it.
So the feds no longer need search warrants? they can just pick and choose to arrest anyone they feel like at the time?
ICE thugs can just arrest everyone named O'reilly because someone with that name is an illegal.?
