Will Kathleen Kane Step Down Now?

In a per curiam order, the Pennsylvania Supreme Court has temporarily suspended Attorney General Kathleen Kane's law license. Since the Pennsylvania Constitution expressly requires that the Attorney General must be a licensed attorney, logic would dictate that she step down. Instead, she's doubled down. Not only has she vowed to complete her term, but did so from the Attorney General website, using public resources to discuss her criminal prosecution.  She just doesn't seem to be getting it.

Look, she's entitled to a presumption of innocence in the criminal case, and will certainly have her day in court. That's her constitutional right. But under that same constitution, she is now unqualified for the position she holds.

If she bitterly holds on, she can still be removed. Option One: The House can impeach her, followed by a conviction in the Senate. Option Two The Senate can exercise its never-exercised direct removal power, which requires a 2/3 majority and the assent of the Governor. Option Three. Any of the Commonwealth's 67 District Attorneys can bring an action in quo warranto.

She's playing with fire. Since she no longer is a practicing attorney, I can see defense attorneys filing motions to quash anything she files as legal nullities. I could even see a defense attorney arguing that, since no qualified person holds the office of AG, any prosecution from that office has to be dismissed.

Instead of being concerned about the effective administration of criminal justice, Kane is misusing the resources of her office to deflect attention away from her own wrongdoing by pointing the finger at others who may have exchanged - Gasp! - naughty emails. While denying anyone who files RTKs the right to see these horrible emails, she wants Justice J. Michael Eakin electrocuted because someone sent him inappropriate messages at his personal email account. Never mind that he sent none himself, and there's no evidence he actually saw the offensive Internet crap that almost everyone receives.

Have you no sense of decency, Kathleen Kane, at long last? Have you no sense of decency?

A poll on my left sidebar asks whether Kane should resign. I'll share the results on Friday.

Stop the hatred of women, Ber...

I couldn't resist, Bernie. The drugged up vamp of West Easton will be chiming in at the usual witching hour after she has her vodka and tonics mixed, and I thought I would beat her at her own game.

I voted for this woman, but it is time for her to acknowledge the jig is up, and resign.

That is not funny Petey. Very inappropriate humor.

Bernie, Bernie, Bernie. As you yourself know you ARE not an attorney so your "legal " opinion is as valuable as D. Trump's.

Your two wet dreams are just that dreams.

One, she is still in charge and unlike you, she is still a lawyer.

two, your dream of Morganelli dancing in to her office is just that, a dream.

Keep trying and thanks for playing.

Everyone is entitled to their day in court and Kathleen Kane is no different. The Supreme Court or the Disciplinary board should have let this alone. She is probably guilty (based on all that' been released in the papers), however, we don't yet have the whole story. And for the flip side of the Courts actions,,,,,,Morganelli will not get her job when and if she should resign. There isn't a Republican in the entire world that would vote for him on that level.

Democrats NEVER have to resign, no matter what.

Just ask Ed Pawlowski!

@10:46 Hans? Is that you? Or is it Bob? Bob Mania?

Thanks for plugging an issue that's important to Allentownians -- and thanks for not discrediting it with your real name. Good causes don't benefit by being mentioned by cowards.

yes if only she had your sense of decency the world would be such a better place.

The man who brought you conduct involving dishonesty, fraud, deceit or misrepresentation; illegal conduct involving moral turpitude etc. renders an opinion

Why not sell the car and give the money to the poor former clients of yours who never received compensation due to your misconduct.

Ms. Kane needs to reach out to Jim Gregory for his expert tutelage and assistance. The bronze adonis, who has burnished his Greek god-like physique with dozens of pushups each day while mediating disputes between the bloods and crips, Muslims and Jews, is a political kingmaker and well versed in making legal problems disappear in the face of his brooding masculinity and overwhelming intellectual might.

oops....er..... he's in prison because of his intellectual capacity (or lack thereof)...

oh well, she's on her own. Unless he Blog Mentor and his faithful horse Mezzacappa are free and want to help her.

Very likely. He usually starts trolling around that time.

You'll notice all the anonymous personal attacks directed at me, some of which contain outright lies. For example, one comment suggests I should sell Mezzacappa's car and give the proceeds to the clients I bilked. There were never any judgments against me. My license was suspended bc when I was drinking, od and could do anything. I never acted out of lucre, and the suggestion that i did is an outright lie. It's like the lie published elsewhere asserting that Jim Martin has lost his defamation action. In fact, the opposite is true.

I thought it was YOUR car? No? Didn't you publish photos of you and Ron standing near it when it was taken?

Bernie O'Hare said...

It is my car. It was Mezzacappa's car.

@B O'H 12:54 It takes a big man to admit that, sir. I admire your courage in being so candid.

You know the Blog Mentor has a history of highly destructive substance abuse -- which last I heard he had beaten, thank G-d -- just as you have conquered your challenges in that area. You'd think he could show a little empathy...

This whole Kane issue has been taken up by an investigative journalist named Wayne Madsen. He has weighed in on the Kane issue as being part of a larger Pennsylvania-wide corruption scandal involving pedophilia and other related sorts of misbehaviour. His article is on his website. He is an interesting guy, with an interesting background, and has been right a time or two in the past, FWIW. I guess we shall see. Or not.

a lawyer who doesn't have a law license or has it suspended , is like having a life guard on duty , but that life guard cant swim or wont swim.
something smells here and im not sure what it is or who it might be.
When Wolfie calls for Kane to pack it in, the jig is up and it is time to move on. another black eye in one of the most corrupt states in the entire country. way to go pa govt officials....lets shoot for number one in corruption...we are gaining on states like New York, California and my all time fave, Illinois. making the democrat party proud like none other....

That is tin foil hat stuff full of inaccuracy, starting with the claim that Kane fired Fina and Costanza for sending naughty emails.

As long as she was going after Rs and protecting Ds, she's fine and should hang on for dear life.

I agree that Ms. Kane has to go.Can't the Governor lock Her out of the office, shut Her out of the State computer and take Her State vehicle. Why is She still here ?

Anonymous said...

7:42 and that makes you happy she is going after r's instead of d's.

this entire state is corrupt beyond belief and I would hope the top law official in the state chases all of the political criminals down.

I could careless if they are r's or d's. if they broke the law they should pay by losing their jobs, their benefits , their pensions and anything else the tax payer is on the hook for.

I despise corruption from both sides. If one does not address the issue, you get issues like FED ED and his beloved corrupt city with no limits of Allentown.

and the media and the hacks from both parties cant figure out why people distrust govt more now than ever.

"Tinfoil hat" Is a term used to describe any person that argues outside the false "Hegelian Dialectic" proposed. It's like calling a person crazy in order to frame their argument as not credible. Sometimes referred to as an Ad-hominem attack.

"The franklin Scandal" was rumored to be Joel Schumacher's inspiration for the movie "8MM"

"Kane fired Fina and Costanza for sending naughty emails" ???

I haven't followed this story so if this is not true; why were these men fired? Can someone point me to a website article contrary to this explanation?

Ed Snowden revelation have revealed how NSA routinely pass nude photos of captured citizens so we know this happens. It does suggest what they do with all the high school photos kids send each other, of which there are many. When or if these kids get into position of power they can be reminded of pass indiscretions. Very powerful control mechanism to say the least.

I would also like to point out that "anonymous" refers to how members in the blog view remarks made by each other. However, to the Webmaster nobody is "anonymous", Ip addresses are known, time and length of time are known, every keystroke and misspelled word are known. To suggest otherwise is disingenuous.

You're assuming that I give a shit who you are. For the most part I will not go through the trouble of trying to determine the IP abd ISP of anonymous attackers like yourself.

As for your actual argument, such as it is, you need look no further than the story itself to see that it contradicts itself . The conspiracy theorist first postulates that these two prosecutors were fired because they were engaged in naughty emails . A few paragraphs later the conspiracy Theorist state that they were fired because they are Republicans..it's wackadoodle nonsense from someone who appears to have little regard for facts.

As evidenced by your post above and your ongoing nonsense for searching for the truth. This is exactly why I wrote a few months ago that David Repyneck was idiotic for agreeing to be interviewed by you. Your mind was (obviously) made up before the interview and your goal was to attack him again on this blog, regardless of his answers to you, which you joyfully did. Any fool should have seen than coming.

Bernie O'Hare said...

There is nothing in the body of my post that is factually inaccurate. She was suspended, An AG must be a licensed lawyer. These are facts. Posting a link to some conspiracy theorist who is unable to get his basic facts striaght IS wackadoodle nonsense. You continued reference to Repyneck is completely off topic. If you don't care for what is written here, don't read it.

I posted a link based on the post by 4:34pm. That's all. The next morning, reading 12:41am comments got me more intrigued so I posted more to add to the subject. Your deletion of my comments shows (to me) your true colors. That's all. I mentioned repyneck just to highlight where I am coming from. I don't fault you for writing about your interaction with him. Actually, quite the opposite is true. I fault repyneck's "handlers" who came to the meeting with him for believing that you'll be fair and impartial. Lanita and Priscilla double-handedly gave the District Justice victory to Tidd. They were fools for believing they could rationalize with you and allowing repyneck into your lair's den. that's all.
