Two Abe Atiyeh corporations, which own two properties "adversely" affected by the NIZ Arena plans, have sued in Lehigh County Court, seeking to have those approved plans set aside. In Atiyeh's Complaint (you can read it here) the authority of Allentown Commercial and Industrial Development Authority (ACIDA), is challenged. Although ACIDA is helping finance and facilitate the project, it is not the owner, developer or operator.
Atiyeh also points to other the City's failure to vacate streets; ACIDA's failure to produce plans for review four weeks in advance; and the Planning Commission's decision to declare the project exempt, as a "municipal use," from certain provisions in the Subdivision and Land Development Ordinance.

Sour Grapes! Abe owns the property at the SW corner of american parkway and union and always hoped for it to be the site of arena/convention center.In a flood plain? Seems like all the so called players are now scrambling.Havent yet heard from jeff trainer.

In this case, the mayor of Allentown and it's planning members needs to be accountable for what appears to be, total stupidity!
This guy seems like a royal pain. I agree with 4:50. I am really tired of hearing his name in the press. It's like dealing with a small bratty child. Stop giving them so much attention, and eventually, they'll act right.

I hope Abe hits a home run! So, everyone else is supposed to be subjected to onerous rules but when the mayor is behind something then all the skids are greased. Abe has made some petty challenges in the past but this one is a challenge for the little guy.

Bernie, I've been silent lately, but your posts on this NIZ, the players, and the impact on surrounding municipalities has been enlightening.

Last time I checked, the First Amendment gives all of us the right to petition our government to redress grievances, even Abe Atiyeh.

This is an interesting lawsuit, that once again sheds more light on the constant array of shady backroom deals and allegations of corruption that plague every aspect of the arena development. Should the arena take advantage of the zoning waivers availble to City related uses? Is the arena a City related facility like the water plant, sewer plant, recycling center etc...? I sure hope not, that's an ever greater indicator that the City tax payers are being put at risk for the financing, maintenance and upkeep of the arena. Attorney Van Luvanee is very good, this should be interesting!
