Municipalities Should Steer Clear of NMM

The above statement from Allentown law firm Norris, McLaughlin and Marcus (NMM) was tweeted by Morning Call reporter Emily Opilo almost immediately after Thursday night's verdict against Allentown Mayor Edwin "Fed Ed" Pawlowski was announced. You see, a member of that firm, Scott Allinson, was found guilty of two felonies as well. The law firm has now formally thrown him under the bus, claiming he "acted alone" and they are all pure. It is time for all Lehigh Valley municipalities and municipal authorities to throw that firm under the bus, too.

During the trial, defense attorneys paraded several NMM attorneys before the jury to piously pronounce that the money they gave to Fed Ed had nothing to do with "pay to play." They just thought he was great. The Mayor's use of Attorney Richard Somach's summer home in Key West has nothing to do with a Parking Authority solicitorship.

Assistant United States Attorney Michelle Morgan told the jury flat out that NMM managing partner Matt Sorrentino lied in his testimony. It doesn't sound like she concluded that NMM has "not engaged in any illegal, improper or unethical conduct."

In an email addressed to his "old friends," Allinson tipped everyone off, back in July, that his indictment was imminent. He was a self proclaimed rainmaker whose firm profile once claimed that he helps businesses "achieve their day-to-day, as well as long-term, business objectives." He has represented the Northampton County Gaming Revenue and Economic Redevelopment Authority, the Northampton County General Purpose Authority, the Northampton County Higher Education Authority, Lehigh’s Economic Advancement Project, Northampton County New Jobs Corporation, Bethlehem Economic Development Corporation, Lehigh Valley Regional Loan Pool, and Lehigh County Industrial Development Authority, Lehigh Valley Economic Development Corporation and Northampton County Industrial Development Authority. From those vantage points, he can really help businesses meet their goals. Whether it is the Chrin TIF or some other major project, Allinson was nearly always involved.

Closely connected to political and business consultant Mike(d) Fleck, Allinson helped raise money for various Fed Ed campaigns. Thanks to Fleck, he also represented Ruckus Brewing in their Neuweiler deal.

Scott Allinson - Pay-to-Play is the "way this shit works."  - According to the federal indictment, Allinson himself has said that his firm receives its legal work, not because the partners are especially gifted, but because they engage in pay-to-play. He is quoted as saying it “isn’t like we are being hired because we are good guys. It’s not the way this shit works.” 

He also reportedly throws one helluva' party. Ask the people at Lehigh Valley Economic Development Corp.He's an "economic development lawyer" who managed to get himself installed as the solicitor to numerous public entities that dole out public money.

His email to "old friends" included members at Integrity Personnel, who were awarded a no-bid $24,000 contract by former Exec John Brown for a "strategic assessment" of the NorCo workforce.

Managing partner Matt Sorrentno was Lehigh County's Solicitor. He also represents Lehigh Valley Health Network. I have high regard for him and his legal acumen. I do not personally consider him a liar, but he should be more than a little concerned that Assistant United States Attorney Michelle Morgan does. I do agree that standing by a lawyer in his firm who essentially accuses him of being a crook is foolish. One has to wonder why so much money was spent by that firm for Allinson's defense.

Richard Somach represents Pawlowski contributor Rob Bennett and Bennett Auto Dealerships. Bennett built a new dealership at the former Exide Battery Plant on Lehigh Street, thanks in large part to $4.5 million in federal brownfield remediation grants.. Somach is an Assistant County Solicitor, Lehigh County Assessment Board Solicitor and is a collections attorney for Nat Penn Bank, among others.

Somehow, he represents banks foreclosing on properties while simultaneously representing the County at Sheriff Sales.

We now know that Fed Ed and his wife used Somach's Florida Keys second home for a vacation. And Fed Ed was going to consider him as Parking Authority Solicitor.

Somach: Booked for you, by the way, your buddy Sam mentioned parking authority may need a new solicitor. Pawlowski: yes give me a few weeks. Somach: thanks for considering me. Pawlowski: you are first on my list.

I'd be remiss if I neglected to mention Oldrich "Ollie" Foucek III, City Planning Commission member and chair, ANIZDA Board member, LV Chamber of Commerce Solicitor and major Fed Ed contributor. He was among those to approve plans for a wholesaler along the Allentown NIZ waterfront despite the fact that there were no ... plans. He is a walking, talking conflict of interest. Being on the Planning Commission and NIZ Board is bad enough, but to be part of a firm that is financially benefiting from both is obscene.

Back in July, I told  you that given Allinson's remarks and his law firm's decision to stand behind him, it would be irresponsible for any public entity to continue association with that law firm.

Nobody listened. Certainly the NorCo GPA failed to listen.

We now know, that in addition to permitting a blatant Sunshine Act violation, NMM lawyer John Lushis actually billed NorCo over $3,000 to copyright six agreements in the firm's name. NMM made over $813,000 for two years on the County's General Purpose Authority (GPA).

This firm is up to its eyeballs in overbilling, conflicts of interest and pay-to-play.

Is it any wonder that the firm makes this boast?

Pay-to-Play, Monroe County Style

After initially setting my GPS to take me some place in upstate New York, I finally made it to Ron Angle's 70th Birthday Bash on New Year's Day at the Chelsea Sun Inn. That's tucked away on Stone Church Road in Upper Mount Bethel Township. Although I could tell lots of stories, I'll limit them to one, at least for now. It's about Monroe County Commissioner Charlie Garris.

Monroe County, like most counties, still retains the Commissioner form of government, elected two people from the majority party and a third from the minority party. Garris tells me he spent $38 in his race. His Republican running mate, John Moyer, spent nothing.

He only won by about 100 votes, and tells me he thinks he should have spent $39.

Pay-to-Play Making Bethlehem Inroads

Just before Independence Day, federal agents descended upon Allentown City Hall with a search warrant and subpoena for information concerning numerous contracts with entities that just happened to be campaign contributors to Mayor Edwin Pawlowski. Just a week later, the same thing happened in Reading. Since that time, Reading's then City Council President, Francis Acosta, and prominent Lehigh Valley entrepreneur Ramzi Haddad have both pleaded guilty to public corruption in what appears to be a major investigation into illegal pay-to-play. Could the same thing happen in Bethlehem? Are special interests like the CRIZ and Martin Tower developers buying elections? An analysis of campaign finance reports filed in Bethlehem from 2013 to present indicate that crony capitalism, in which business interests and politicians co-opt each other, is making serious inroads.

Bethlehem Mayor Bob Donchez recently imposed a gift ban on all city employees to avoid even the appearance of impropriety. But roughly $1 out of every $3 contributed to his campaign, or 33%, comes from unions, developers, engineers and others who have a vested interest in the Bethlehem's CRIZ, TIF or other City-sponsored projects.

CRIZ participants Dennis Benner (Greenway Park), Lew Ronca and Norton Herrick (Martin Tower), J.G. Petrucci (Third St), Jeff Trainer (Sands Convention Center, Mike Perrucci (3rd St) and Majestic Realty's Ed Roski (LVIP) are all contributors. Is it coincidence that they, as one other developer puts it, "are controlling the cards and not letting anyone else at the table?"  

Their influence only begins with Donchez. It also extends to his political rival and opponent in the 2013 Mayoral race, City Council President J.William Reynolds. His finance reports show that 28% of his election funding comes from the same vested interests.

When major contributions from Ronca and Herrick were called into question at a recent City Council meeting concerning zoning changes at the Martin Tower site, Reynolds called on Donchez, who accepts the same kind of contributions himself, to vouch for his integrity.

A similar pattern exists among incumbent Council members Mike Recchiuti (36%), Bryan Callahan (31%, as well as incoming Council member Shawn Martell (25%).

Recchiuti defends the practice. "I am proud of the support I have received," he has stated. He insists that contributions from Martin Tower interests only make up 13% of his total fundraising. "As a City Councilman, I have always put the interests of the entire City of Bethlehem first, and will continue to do so for the remainder of my term."

But there's another group of Council members who are much more sensitive to accepting money from developers and related business interests that depend on government favoritism to succeed. Eric Evans (12%) and Adam Waldron (3%).have much smaller contributions from these special interests.

In January, they will be joined by two Council members who believe that putting the City's interests first should rule out accepting money from developers and engineers who are looking for CRIZ or NIZ tax breaks. Olga Negron and Michael Colon, elected from the Lehigh Valley's growing Latino community, relied on grass roots support and family instead of crony capitalists. While Negron has stated that she supports the CRIZ, "we do not want to provide a license for [developers] to destroy our city’s historic treasures or diminish the character of our charming neighborhoods." She is apparently referring to the Martin Tower development, one of the CRIZ projects.

Neither Negron nor Colon take office until January. Council is scheduled to vote on changes to Martin Tower zoning before then to make it more "flexible" and allow more retail. Historic downtown and South side merchants have spoken forcefully against this proposal. The decision will be made by a 7-person Council, two of whom were appointed. Three of these Council members indicated before a word was spoken at public hearings that they support rezoning at Martin Tower. Reynolds went so far as to interfere with a Planning Commission review in July.

According to Common Cause, Pennsylvania is one of only 11 states that impose no limits on campaign contributions. In 1992, then Governor Bob Casey called on the state legislature to "liberate the electoral process from the tyranny of the campaign dollar." Instead, individual campaigns in local races are often in excess of what can be contributed to someone running for the United States Senate.

Since there's no urgency to Martin Tower and three new Council members will take office in January, it makes sense to table this rezoning when Bethlehem City Council convenes this evening. Wait for seven people who were actually elected. But Recchiuti is unwilling to wait for the next Council. "I plan on doing my job until my term expires," he insisted. "I do not believe I would be serving those who voted for me by deferring tough decisions to the next council. I also believe it would be inherently unfair for this council to leave those tough decisions for the future inexperienced council members to make so early in their term."

Tom Hahn Challenges Allentown City Council's Ethics

Democrat Jeanette Eichenwald and Republican Vic Mazziotti came together last week to urge the adoption of pay-to-play rules in Allentown and Lehigh County. I was encouraged to see that Vic's colleague, Mike Schware, as well as and Lower Macungie Commissioner Ron Beitler, were also present. But despite an invitation from Eichenwald, no other Allentown City Council member came. This was an insult, not just to Eichenwald, but to the people of Allentown. City Council is required to represent their interests, not those of Mayor Ed "Fed Ed" Pawlowski, political and business consultant Miked Fleck or entrepreneur Abe Atiyeh.  Instead of serving the people, these elected officials rubber stamped a deal to pay Abe Atiyeh almost three times what its own appraiser recommended to buy property it never needed.

It was a pay-off, to put it bluntly. City Council never bothered to ask for the appraisals or even seek the identity of the seller. Clearly, they deprived the citizens they represent of their right to honest services. The only person who had the integrity to say No was Eichenwald

Tom Hahn is an Allentown City Council critic who castigated them two weeks ago. They said nothing. Maybe he should sing to them, like Tom Ochse. What hes done instead is send them a "communication" to be noted during the meeting, challenging their ethics.

The time is now at the next meeting to start the change. All members of council must face the public on Moral ground with an ethical challenge to protect the public from future actions that have jobs, deals, charter rule changes, and no oversight on issues. As was admitted by Julio in his last press release, "I did not research the issue" is what was reported. The public did and the information was not used or believed? Again the misleading information that was giving to council was flawed coming from the administration consultants and never compared to the public's information. Never a debate in a public meeting, only the 3 minute rule. Sit down, your time is up. The questions became a moot item. We know how proud the council is of this fact, because the no answer was the only answer.

The first issue is the vote to correct the pay to play issue . If you and the other members are not ready to change, and restore the charter rules back to their original intent, then Ccouncil is the reason we have this issue in the first place .

The letter to council will not change one thing I was told, but I had to try to find Moral ground and end this issue on a positive note. That honesty and good government still resides in Allentown by the way council will change the rules, charter and preserve the city from complete ruin . Protect all the citizens - rich, poor, any color, religion, and even the ones who disagree with Council - without reprisal from the Mayor or Council's vote. We all know that pay to play is not dead yet, but could be if the vote is right.

History will be the judge. Which Council was the worst to bring shame to Allentown and cost the tax payers the highest amount of money in fees and water rates. The list is growing.

The responsibility is on Council's shoulders to correct the situation ASAP to give hope to all residents of our city that a new beginning has started.

Vic Mazziotti Takes Aim at Pay-to-Play in Lehigh

Allentown likes to call itself the City Without Limits. But it's in a jam largely because it's located in a state without campaign finance limits. If someone is running for Congress, federal law prohibits me from giving him more than $2,700 per election. But I can give a borough council candidate $1 million. This makes no sense. To make matters worse, our mostly toothless campaign finance laws are often winked at or openly disregarded. It's an environment in which corruption is inevitable. This year alone, prosecutions are pending against Attorney General Kathleen Kane, U.S. Congressman Chaka Fattah,  former Harrisburg Mayor Stephen Reed, State Treasurer Rob McCord, Reading City Council President Francisco Acosta and five current and former State Representatives from the Philadelphia area. A federal investigation into pay-to-play practices is going strong in Reading and Allentown. Despite this climate, experts predict no reforms from the Land of Midnight Payraises. Fortunately, Lehigh County Commissioner Vic Mazziotti plans to introduce pay-to-play legislation. Unable to do anything statewide, he can at least discourage it in Lehigh.

Mazziotti's bill is modeled after the pay-to-play legislation adopted in Philadephia in 2005. It imposes campaign contribution limits and may impose restrictions on vendors seeking County business. When I have more details, I will share them.

The biggest argument I hear against campaign finance reform measures is that there is no way you can stop people from breaking the law. But if that argument has any validity, we should immediately repeal our murder and bank robbery laws.

Since Mazziotti is a Republican on a Board dominated by Republicans, and no one in trouble this year happens to be a Republican, I think its chances are very good.

The same might be true on the state level, despite what the experts seem to think. In 2009, when they were still mortals and had not yet been elevated to the judicial heavens, Craig Dally and Doug Reichley sponsored legislation aimed at curtailing pay-to-play. It went nowhere because they were Republicans in a legislature dominated by Democrats.

Last year, it was Democrat Brandon Neuman's turn. His proposal to curtail pay-to-play in state contracts went down 91-107, largely along party lines.  But State Rep. George Dunbar had some success with a law that would prevent a state employee from evaluating any contract proposed with an organization at which he was employed in the private sector.      .

Last year, most of those in trouble were Republicans. This year, the Dems are getting hammered. Legislation aimed at ending pay-to-play, proposed by a Republican, could pass this year if one was offered.

Source: Flipped Fleck Was Wired For 90 Days

By now, many of you have seen The Morning Call story citing anonymous sources to report that former political consultant Michael Fleck secretly recorded conversations in what increasingly appears to be a pay-to-play investigation. Ironically, I heard a similar story yesterday from a law enforcement source with ties to the Allentown office of the FBI. I was told a few things I don't see in The Morning Call story, and their story reveals a few things I had not heard.

What Morning Call Sources Say

From The Morning Call story, we know that they are relying on anonymous sources (that's plural). I have just one. Their sources say that Fleck recorded meetings with his customers and with Mayor Edwin Pawlowski.

What My Source Says
  • Fleck was wired for 90 days.
  • He recorded conversations for at least 30 fund raisers and over 100 meetings.
  • They have many hours of taped conversation. 
  • They know where he is in Georgia, and it's within spitting distance of a field office.
When I first head this story,  my question was whether I could rely on just one source. After discussing it with Michael Molovinsky, I decided to go ahead with it and just make sure you were aware I was relying on just one source. Then the Morning Call story appeared. I realized what is going on. The only reason The Morning Call or I have this story is because the FBI want us to have it.

They are shaking the trees to see if any ripe apples fall.

This also tells me three things about their case. First, it is very much a pay-to-play investigation, and is looking into Allentown Mayor Ed Pawlowski and Reading Mayor Spencer Vaughn. Second, the FBI insisted that Fleck wear a wire because recordings will corroborate what he says when he testifies. Finally, by using a bad guy to get other bad guys, they are possibly setting up a defense of entrapment for some targets.

The Ruchlewicz connection

I also learned yesterday that in April, feds were visiting neighbors of Sam Ruchlewicz, a Fleck partner at his business consulting firm. His Twitter account states, "Government, Politics, Business -- They all meet with me."

That might be one of his problems.

You see, in addition to acting as a political consultant for candidates seeking elected office, Fleck also acted as a "consultant" for private businesses seeking an inside track with the very people that Fleck would help elect.

Though there is no law barring this practice, Common Cause Pa Exec Director Barry Kauffman warned that it invites mischief.
"What you have to be cautious about, in this case the campaign manager is obviously a very influential person. ... The mayor needs to be cautious the campaign manager doesn't try to influence public policy decisions and serve as a conduit for major businesses who end up being campaign donors."
Fleck told The Morning Call that he keeps his business and political consulting in two different worlds, a point that was confirmed by Mayor Edwin Pawlowski.

But a campaign finance report filed by the Citizens For a Greater Reading PAC.tells a completely different story.

First, it was filed by Ruchlewicz, who was supposed to be in the business, and not political, consulting world.

Second, the $33,260 in contributions include people with no connection to Reading. Why would Sean Kilkenny, who is running for Sheriff in Montgomery County, donate $5,000 to a reading-based PAC? Why would Abe Atiyeh, who had hired Fleck and Ruchlewicz as business consultants, donate $2,000 to a reading PAC?

Third, business consultant Ruchlewicz walked away with $1,200. Fleck's H Street Strategies' take was $10,000, nearly a third of the money contributed.

Major businesses with City and NIZ contracts have been big campaign contributors. J.B. Reilly, Sean Boyle and Abe Atiyeh bankrolled a Pawlowski and Fleck inspired effort to get rid of Mayor Ed Hozza in Allentown,

The business and political consulting obviously merged.

Cunningham: Pawlowski For Sale

I've long claimed that Allentown Mayor Edwin Pawlowski has taken "pay to play" to unprecedented heights in the Lehigh Valley. When potential city contractors call him, he even schedules their appointments during fundraisers. One hand washes the other. Of course, it's legal bribery. So some nitwit blogger is complaining about King Edwin's ethics, what else is new? Funny you should ask, because someone with a little more credibility than me is asking some interesting questions about King Edwin and his connection with political power broker Marcel Groen. That person? Lehigh County Exec Don Cunningham.

In a riveting report by Morning Call scribe Jarrett Renshaw, we learn that Groen's law firm has been paid over $350,000 by Allentown since 2006. We know that Groen himself is a Pawlowski and Callahan campaign contributor who attracts other donors. But his real strength is his ability to help someone with political aspirations.

Someone like King Edwin.

Don Cunningham bluntly states that with Green, "it's about money and business." He does not stop there, but adds this. "So anyone that wants to run statewide must go through Montgomery County if they want to advance themselves. ... Clearly Pawlowski has developed that type of business and political relationship with Marcel."

What Cunningham is saying, if you read not so closely between the lines, is that Pawlowski is a crook willing to sell out Allentown for a higher office.

The Auditor General race is coming up in 2012.

Pay-to-Play Perrucci Tapped For Lehigh County Chief PD

About eighteen months ago, back when he was still regularly attending Council meetings, Lamont McClure tried his best to have Bethlehem attorney Christian Perrucci appointed as Northampton County Council's Solicitor. McClure actually went so far as to take it upon himself to fire Council's then Solicitor, and over the Christmas holiday, with absolutely no authority from other Council members.

For that little stunt, McClure was awarded a coveted Express Times turkey. But Perrucci remained first choice of Northampton County machine Democrats. Lame duck council member Diane Neiper asked council members to appoint Perrucci. So did then Council Prez Ann McHale. They needed five votes, but could only get four. So sad.

Why were they so hot for Perrucci? Is he a municipal law expert? Home rule scholar? Nah. Much better than that, he's a pay-to-play specialist.

Pennsylvania campaign finance records place Perrucci very solidly in the "pay to play" camp. In just three years, this young lawyer has already contributed $14,550 to state office candidates. This includes $4,000 to convicted state house Democratic whip Mike Veon, who was sentenced last month to 6-14 years in prison for his involvement in Bonusgate. Another $1,000 found its way to former state house Democratic whip and payjacker Bill DeWeese, who has also been charged.

Did I mention that Perruccis just love Don Cunningham? In the last two years, he's picked up $7,800 from John and Christian. To be fair, Christian also gave $1,000 to Pay to Play Pawlowski. I'm sure King Edwin will remember this loyal vassal.

Perruccis like John Callahan, too. Christine Perrucci has already maxed out, with $4,800 for Callahan's Congressional bid against Charlie Dent.

Perrucci is part of a "pay to play" family. He practices law in a firm started by his father, Phillipsburg attorney Michael Perrucci, and former NJ Guv' Jim Florio. Like his son, Michael is very generous to Democratic candidates for state office, and has contributed at least $25,730 over the years to Governer Rendell, John Morganelli and others. His law firm represents the Delaware River Joint Toll Bridge Authority, rest home for political hacks. As a Director of ClearPoint Business Resources in 2007, his total compensation was a paltry $54 million.

Who knows just how much money Christian has given to local candidates? I do know that Christian's sister, Bonnie, has contributed $200 to Lamont McClure. But it's harder to follow the money in local races.

Yesterday, Lehigh County Executive Don Cunningham finally rewarded Perrucci for all those contributions with an appointment as Lehigh County’s Chief Public Defender, a part-time job that pays $53,288. Benefits, too!! Perrucci will replace current Chief Public Defender Chuck Smith, who is stepping down today.

According to a County news release, Perrucci "has extensive experience in litigation and criminal law." Really? I spoke to one of the Lehigh Valley's best criminal defense attorneys, who tells me he's never seen him in a courtroom. Now according to his biography, Christian does have some experience in Alpha, N.J., prosecuting speeders and jaywalkers, so he's got that going for him. But I have to wonder what the hell he'll be advising indigent defendants. That they should learn to pay peoplwe off like he does?

Perrucci’s nomination now goes to the Lehigh County Board of Commissioners Intergovernmental Committee for confirmation on July 28.

Maybe he should write out a few checks for them, too.

Show Your King Edwin Pride

I told you I thought it was a bit tacky for Allentown to schedule a goofy bike race on the ninth anniversary of 9/11/, the very day that nearly three thousand people were murdered only ninety miles away. Some of you disagree, arguing that, unless we have this bike race, the terrorists win. We can still commemorate what happened by going to church before or after the race. You may be right, but I think it's too soon.

When it comes to being tacky, it's hard to beat King Edwin. The latest from his camp is a "Show your Ed Pride!" drive. Pride Package I, which costs just $10, includes a Nail File, Pen and Gripper! High rollers can buy Pride Package II, which costs a trifling $25, and includes T-Shirt, Magnet, Nail File, Pen and Gripper! In the email blast hawking these wares, you're warned to "Hurry! Supplies are limited!"

King Edwin has plenty of other packages, too, although they appear to be missing from his email blast.

Pay to Play Pawlowski Rakes in $20k in One Month

When confronted earlier this year by Morning Call reporter Jarrett Renshaw over his prolific fundraising and the possibility of "pay to play," Allentown Mayor Edwin Pawlowski denied he would stoop to such a low level. He went to Bible College, damn it. ''I have done everything I could to separate myself from these problems.'' Yeah, like collecting business cards from city vendors so he can hit them up for donations. Or making appointments to meet them during his fundraisers.

Pawlowski's post primary campaign finance report, which spans just a one month period, reveals he's raked in another $20,857.33, approximately the same sum of money that Northampton County Executive John Stoffa used to finance his entire campaign. I've posted Pawlowski's report online and you can access it here.

It's the usual suspects of vendors, attorneys and developers. Philadelphia law Cozen Connor, for example, kicked in $3,000. This is in addition to the $2,500 contributed last year. That firm has received huge sums from Allentown for negotiating police contracts. No pay to play there.

Bennett Toyota was recently given $4.5 million in public grants and loans to move to the Old Exide Battery plant. That's according to the city's own web page. Bennett donated $2,500 to Pawlowski's campaign. This wheeler dealer also provided Pawlowski with a car and two minivans on election day. No pay to play there, either.

What kind of Bible School did he go to, anyway?

Update: The $4.5 million in public funding I mention did not go directly into bennett's pocket, but to remediate the land. So Bennett benefits, but only indirectly.

Pawlowski's $2,000 Union Shakedown

When confronted last month by Morning Call reporter Jarrett Renshaw over his prolific fundraising and the possibility of "pay to play," Allentown Mayor Edwin Pawlowski denied he would stoop to such a low level. After all, he went to Bible College, damn it. He also claims, ''I have done everything I could to separate myself from these problems.''

I'd like King Edwin to explain an April 6 fundraising letter to unions (you can read it here). He not only solicits $2,000 contributions, but clearly suggests some sort of quid pro quo, pointing to very specific pro-union activities that leave me wondering whether he is a mayor or union agent. His letter makes these points.

* He was "the lone voice as a community leader" in urging Congressman Charlie Dent to support the pro-union Employee Free Choice Act. He attaches a letter to Congressman Dent, penned on the city letterhead.

* He protested "the virulent anti-union campaign engaged in by DHL" in response to workers' efforts to organize.

* He takes credit for the Housing Authority unionization.

* He "internalized and unionized jobs that were formerly outsourced, i.e. janitorial services."

* Allentown's "professional licensing ordinance" demonstrates "my firm commitment to unions."

In exchange for these pro-union efforts, Pawlowski wants more than some union endorsement. "I am requesting a contribution of $2,000 to my re-elect campaign which will ensure our victory in November. I would be most grateful to receive your contribution before the primary on May 19, for it will keep our momentum building toward a final victory in November."

Rather than separating himself from potential problems, Pawlowski looks like he's selling his office. His fundraising letter looks very much like a shakedown.
Update: Text of Pawlowski's April 6 Union Solicitation A commenter has asked me to post the text of Pawlowski's letter here.

"As Mayor of the City of Allentown and a strong supporter and advocate of organized labor, I write now to request the endorsement of the [redacted] in my race for a second term as Mayor. 1 also ask for your financial support and volunteers as well, both very crucial to the success of my campaign and my victory in November. As Mayor, I vow to continue my initiatives into the future and achieve the results we all look forward to. and I need your vote in order to do that.

"I would like to take this opportunity to mention my past performance on behalf of labor in the Lehigh Valley within the context of my job as Mayor of Allentown. I have always taken a stand for the rights of workers and have spoken out against corporate labor law violations. The enclosed letter, which I wrote in 2007, shows my strong opposition to the virulent anti-union campaign engaged in by DHL in response to the workers' efforts to organize their union with the American Postal Workers Union, AFL-CIO.

"Additionally, I have been the lone voice as a community leader in urging Congressman Dent to reconsider his position on HR 800 and vote to provide expanded protection for labor union organizations. The Employee Free Choice Act legislation must be passed in order to ensure workers' common sense approach to organizing and negotiating and thereby preserve and honor the grand pro-union heritage of the Lehigh Valley. Please see the enclosed copy of my letter to Charlie Dent dated March of 2007 urging him to cast his vote in favor of this critical safeguard.

"As Mayor I opened the door for the Housing Authority staff to be unionized. On another front, I led the way for our school district to work with the labor council to create a labor sponsored apprenticeship training program at the Allentown schools. In addition, I internalized and unionized jobs that were formerly outsourced, i.e. janitorial services. And finally, I joined with the Sheet Metal Workers to create a professional licensing ordinance in the City of Allentown, only the second city in the whole state to accomplish this. Altogether this demonstrates my firm commitment to unions and represents substantial strides for organized labor under my leadership.

"Therefore, I humbly ask for the endorsement of the [redacted] and for a personal endorsement as well. In addition, I am requesting a contribution of $2,000 to my re-elect campaign which will ensure our victory in November. Craig Dally: Time to End "Pay to Play" Politics in Pennsylvania

Pay to play is so prevalent in the Keystone State that our abbreviation should be changed to PAY. You know things are pretty bad when state senator Vince Fumo's five-month public corruption trial takes a back seat to predatory Luzerne County judges. Modern day Fagins, they sent young Artful Dodgers into juvenile detention facilities and received hefty kickbacks for their trouble. Former state house Democratic whip Mike Veon is under indictment for Bonusgate, and current state house Democratic whip and payjacker Bill DeWeese likely will soon be Defendant DeWeese.

Like living near Chrin landfill, we eventually get used to the smell. Ann McHale wanted to infect Northampton County Council with Christian Perrucci, a Bethlehem attorney and playa' who has padded the campaign coffers (defense funds?) of both Veon ($4,000) and DeWeese ($1,000). I hear he's a nice guy. McHale failed. Allentown Mayor Ed Pawlowski, who actually collects business cards from city vendors so he can later solicit campaign contributions from them, bristles at the suggestion of any ethical improptiety.

After all, he went to bible college.

This goes on at the gubernatorial level, too, except boatloads more money is involved. Get this. A Houston law firm just happens to cough up $91,100 for the Guv's coffers, and Rendell manages to find some way to award a no-bid contract to that very firm for some lawsuit against some drug manufacturer. At least Rendell makes no hypocritical bible college claim. He hopes the firm gets millions.

State Rep. Craig Dally (R-Northampton), a reformer, has had enough. His office issued a news release on Friday, and I am publishing it here in its entirety.


"A recent Wall Street Journal editorial, 'The State Lawsuit Racket -- A case study in the politician-trial lawyer partnership,' was especially troubling because the case occurred right here in Pennsylvania.

"The Journal described a motion by Janssen Pharmaceutical, a defendant in a torts case, that was seeking to invalidate a contingency fee contract signed by the Rendell administration. Janssen’s argument was based on the grounds that the contract was obtained by the law firm through corrupt means.

"The
Philadelphia Inquirer also reported on the story detailing the relationship between the Texas law firm of Bailey, Perrin, Bailey and the Rendell administration.

"The editorial described the timing of more than $90,000 in campaign contributions to Gov. Ed Rendell’s 2006 re-election effort from F. Kenneth Bailey, founder of the law firm, as well as what can best be described as a sweetheart deal that the law firm secured from the state for its services in the case.

"The Bailey case is the most dramatic incident of what some might call 'pay-to-play' in Pennsylvania. During his six years in office, Rendell has taken advantage of a weak state law in order to give preferential consideration to campaign contributors and associates in his former law firm.

"Earlier this session, concerned about the appearance of a 'pay-to-play' system in Pennsylvania, I joined a group of House members in sponsoring legislation to reform state contracting procedures for all three branches of government. Now, more than ever, I believe the measures are essential to protect Pennsylvanians’ tax dollars.

"The bills we introduced aim to effectively end pay-to-play politics in Pennsylvania.

"The measure I sponsored,
House Bill 384, would prevent exactly what happened in the Jansen case. It prohibits law firms from receiving more than $500,000 in state legal services contracts in any single year without open and competitive bidding. The law also forbids the Commonwealth and any of its agencies from entering into any contract with a law firm that allows for the payment to the firm to be based upon a contingent fee arrangement. This is the third session that I introduced the bill.

"Other bills in the package would:

"1) Ban any contract from being awarded to a person, partnership or corporation that donated to the campaign of a candidate for statewide or local office within one year of the date a contract is posted for public bidding. This includes contracts at the state, municipal, county or school district levels and any officeholder with discretionary control over contracts.
"2) Remove “legal services” from the definition of contracts that can be awarded by the governor under the emergency provisions of the Procurement Code. This should be restricted to natural disasters or extraordinary events.

"3) Require any extension of an existing state contract for services to be posted on the Department of General Services’ Web site for 10 business days before the contract is submitted to the attorney general for review of form and content in an effort to allow competitor bidders to indicate interest.

"4) Require any contract to be let by the executive branch or any legislative caucus with an initial value more than $100,000 to be subject to the Procurement Code and undergo competitive bidding and requires the awarding of contracts only to firms on an approved list of contractors.

"If the governor is serious about restoring the public’s trust in state government, he should come out in support of my efforts and others who have been trying to reform Harrisburg for years."

Allentown Mayor Ed Pawlowski Too Holy for "Pay to Play"

Two words. Caesar's wife.

Pompeia was almost certainly innocent. But when a man was discovered in her home during the Bona Dea festival, a ritual supposedly open only to women, Rome was scandalized. Caesar, the high priest (Pontifex Maximus), immediately divorced his second wife. As he put it himself, "Caesar's wife must be above suspicion."

Like Pompeia, Allentown Mayor Ed Pawlowski is under a cloud of suspicion. As a brilliant piece of investigative journalism by The Morning Call's Jarrett Renshaw makes abundantly clear, Hizzoner's campaign finances clearly reveal an appearance of impropriety.

Pawlowski, who incredibly admits using business cards supplied by city vendors to solicit campaign contributions, goes on to claim he's still acting ethically because he graduated from bible college.

Alrighty then. Pontifex Maximus Scott Armstrong, at The Allentown Commentator, points out the absurdity of Pawlowski's plea.

Here's a general rule of thumb, when one believes firmly in their own sanctity trouble is sure to follow. The hubris that arises when doubt is lacking is often very destructive. History is full of calamitous case histories of those who never doubted their own sincerity and goodness. Judging by Ed's own words in the "Pay to Play" article and his constant use of similar rhetoric in the past can there be any doubt that he falls into the same category? From the start Ed has used his Moody Bible degree and his "Faith" as a selling point for his political advancement. Now he is using the same as a shield to fend off any doubts as to his intentions and to rebut accusations of wrongdoing.

Ed seems to use his Moody Bible degree and his "Christianity" as both a vote getter and a "get out of jail free card." The mayor wears his links to Jesus right on his sleeves and waives them around when it is convenient. This was of course the case again in the "Morning Call" article that detailed links between those who gave to Ed's nonstop campaign and awards for city contracts. His remarks were plain enough; how dare we question Saint Ed, don't we understand what a truly good and godly man he is?

One may choose to put their faith in God, but it is never wise to do the same with any elected official. We should all be wary when any politician uses his or her faith and/or religious training as a technique to ward off questions or concerns regarding their stewardship of a public office.

Ann McHale's "Pay to Play" Solicitor Rejected by 5-4 Vote

Bethlehem attorney Christian Perrucci has spent the past few months lobbying individual council members for a $49,000 part-time job as Northampton County Council solicitor.

It's the least they could do.

Over the past two years, this young lawyer has already contributed a whopping $12,775 to Democrats seeking state offices. This includes $4,000 for former state house Democratic whip Mike Veon, currently under indictment for Bonusgate, and another $1,000 for current state house Democratic whip and payjacker Bill DeWeese.

Not surprisingly, Perrucci was the first choice of Northampton County machine Democrats when county council reorganized in January. But they only had four votes, so their attempt to inflict this campaign philanthropist upon unsuspecting taxpayers failed.

Now that Democrats have a five-four majority, they tried to bring this fox into the Northampton County henhouse for a second time last night. Lame duck council member Diane Neiper asked council members to appoint Perrucci, and Council Prez Ann McHale gravely told everyone she supports Perrucci, too. I'm sure McHale is expecting him to open his check book and finance her county exec campaign.

But not all Democrats are machine Democrats. Bangor Mayor Joe Capozzolo (you can read about him here), appointed to fill Wayne Grube's vacant seat, had other ideas. He likes county council's current solicitor, Anthony Martino.

McHale tried her best to steer the appointment to Perrucci and away from the slate belt. She even cut Ron Angle off as his made a pitch for this fellow slate belt resident. Previously, Attonry Martino was prematurely fired by council member Lamont McClure. Classless and clueless, he did it by letter over the holidays.

Merry Christmas! You're fired.

That stunt earned McClure a coveted Express Times turkey.

As Angle noted that "we've humiliated Mr. Martino enough," the Queen of Hearts cut him off in mid sentence.

"Mr. Flisser, will you please call the roll."

When the dust had settled, all four Republicans had sided with Capozzolo and Martino was selected by a five-four vote. Martino arrived a few minutes later and took his seat on the dais, but McHale offered no congratulations. Ron Angle attempted to do so, but she cut him off again.

"Please, Ron."

McHale failed to deliver the bacon for Pay to Play Perrucci. Even worse, she managed to alienate slate belt voters in the process. They tend to remember things like that.

Now don't feel sorry for poor Christian Perrucci. In late October, he gave $1,000 to Pay to Play Pawlowski. I'm sure King Edwin will remember a loyal vassal.

Pay to Play Pawlowski Raises $101k in 2008 From City Vendors, Lawyers and Contractors

In 2006 and 2007, Allentown Mayor Ed Pawlowski raised a whopping $108,588, mostly from city workers, developers, contractors, consultants and lawyers who do business with the city. Along the way, Pawlowski has thumbed his nose at election laws requiring public disclosure of his "pay to play" pals. He has filed reports late and has illegally tried to use campaign funds to pay late fines. Recently, he falsely claimed, in a sworn statement, that he had received no contributions at all between January and October of last year.

Lehigh County Voting Registrar Stacy Sterner, made aware that Pawlowski's report was false, ordered him to re-file. He finally did so late Wednesday. Instead of the goose egg originally claimed, Pawlowski actually raised $101,599 in just the first ten months of 2008, nearly as much money as in 2006 and 2007 combined.

Principals at Nic Zawarski & Sons have kicked in $3,850 in addition to the $13,350 paid between 2005 and 2007. Attorneys at Gross, McKinley, LaBarre Eaton tacked $3,400 onto the $5,600 contributed between 2005 and 2007. And so it goes.

Not too long ago, then managing director Francis Dougherty urged city workers to cut through the red tape for some big wig who wanted an inground swimming pool. He flatly stated that quick action "means money from air products later." Last year alone, Pawlowski's campaign raked in $1,500 from Air Products.

It's called pay to play.
