It Could be more than a turf issue if they are exercising police powers without police traiing. Act 120 has a very real purpose,and without it there is not sufficient training to deal with the many hazards to the sheriffs not the public. It is not a turf war, it is a public safety and legal issue. Beyond the obvious, it also means that without that training the government agency who dspatches the sheriffs is open to law suits which could get costly. All in all it is a very serious question about a very seious matter
This issue has been talked about for ever.The first reason raised was that Deputy Sheriff's are not trained to Act #120 requirements. Deputy Sheriff's in Pennsylvania attend a 19 week academy at a central academy in State College just like the State Police. The recruits cover all aspects of law enforcement from patrol procedures,vehicle traffic stops to crime scene, investigations. The only difference is Deputy Sheriff's receive training in Civil Law were Act #120 do not. Ever since our founding father landed in Pennsylvania which is still a Commonwealth not a State the Sheriff has been the Chief Law Enforcement Officer of the County. The District Attorney has been the Chief Prosecutor of the County. But getting back to this ridiculous notion that Deputy Sheriff's are not trying to get more powers. Nothing has taken away those police powers take Pennsylvania Deputy Sheriff's have. Let make this clear. No legislation has abergated those police powers of Pennsylania Deputy Sheriff's. We all need to get pass this crap and call it like it is. It is a turf issue. It about who is the biggest and baddest,and it needs to stop. Any law enforcement professional who does not respect another law enforcement professional should be ashamed. Because in reality we all need to work together to accomplish the goal. A better society
The problem is in 96% of the states, County government rules over all unincorperated land (municipalities) which inclues law enforcement through the Sheriff's Office. But in Penna., there is no unincorperated land. Every square inch belongs to a sovern municipal goverment elected by their residents. If there were unincorperate land in a Penna. County, then the Sheriff would be the rightful law enforcement officer. So until Townships and Boroughs unincorperate and revert to County rule, Sheriffs have no reason to be anything other than Court Officers.
