Negron, Van Wirt Oppose Bill To Eliminate Wage Disparity in Bethlehem



As hard as this might be, I actually feel sorry for Bethlehem City Council member Bryan Callahan. He recently introduced an ordinance aimed at eliminating the wage disparity we all know exists between men and women. You'd think Olga Negron (Mayor Dumbass) and Paige Van Wirt (call me Doctor), two of Bethlehem's three female Council members, would jump all over this. They both no doubt have experienced the gender pay gap. They and Callahan are the three members of Council's Human Resources Committee. But amazingly, they voted on Tuesday to delay Callahan's bill. Not just that. They jumped all over Callahan, too. Negron told Callahan to "shut up" while Van Wirt insisted she be addressed as "Doctor." After the meeting, when she thought the mike was off, Van Wirt pointed at Callahan and threatened, "Don't bring up my business." Negron and Van Wirt might claim to be champions of women's rights, their actions tell a different story. They would rather hurt Callahan than help women. This is classic bad government. I expect this from Negron, but Van Wirt's behavior is very disappointing

Without question, wage disparity exists. The Third Circuit Court of Appeals recently summarized the data in a February 6 opinion upholding Philadelphia's Wage Equality Ordinance:
According to the 2015 census, women in Pennsylvania earn 79 cents for every dollar earned by similarly situated men. For women of color, the wage gap is even more profound. Black women earn 68 cents for every dollar paid to similarly situated men, and Latina women earn 56 cents for every dollar paid to similarly situated men. The gap begins for women as soon as they enter the workforce. In just the first year after college, fulltime working women earn, on average, just 82% of what their male peers earn. Overall, women under the age of 35 earn 88-91% of what their male peers earn. Rather than improve, as women gain experience in the work force the situation gets worse. Women aged 35 and over earn only 77-81% of what male peers earn.
Callahan's legislation addresses this gender pay gap by banning employers from asking job applicants to disclose their wage history. The law would become effective one year after enactment to give businesses time to become familiar with the change. After that, a boss who asks for a wage history could get hit with a fine of up to $1,000 in a private action. The City's Human Relations Commission lacks the resources to enforce this law, so it would be up to the victim. 

This proposed wage history ban is similar to the law recently upheld in Philly. In Pennsylvania, state agencies are banned from asking an applicant to reveal his or her job history. In Pittsburgh, city officials are barred from asking a job seeker to disclose prior salaries.

Throughout the country, there are 17 state-wide and 20 local salary history bans.

"And we're Bethlehem," responded VanWirt when Callahan attempted to point out that salary history bans are being implemented throughout the country.

During the hearing, Van Wirt noted that Callahan had called her and promised he would even support Olga Negron as Council President if they would only support this legislation. She told him then that she had unspecified "concerns."  She instructed Callahan that it was his job to reach out to the women on Council to come up with a workable ordinance.

"The time to do this was before this committee meeting," she declared.

In other words, behind closed doors in violation of the state Sunshine Act. The people's business, with very limited exceptions, should always be discussed openly.

"Miss Van Wirt," began Callahan.

"Dr. Van Wirt," snapped Van Wirt.

"Councilwoman Van Wirt," continued Callahan. "In here you're a Councilwoman."

"Councilwoman or Doctor will be fine, thank you."

She didn't spend six years in evil medical school to be called Miss, thank you very much.

Negron complained, perhaps rightly, that the onus for enforcement is on the job applicant. Van Wirt said an employment lawyer would cost $5,000.

That's just nutz.

Solicitor Jack Spirk said that perhaps the fine could be directed at attorney fees.

Neither Van Wirt nor Negron was willing to offer amendments to make the ordinance more workable. They both voted to postpone the matter and also made clear they are unwilling to offer future amendments.

A baffled Callahan pointed out they both had known about the hearing at least a month in advance.

"If you want to respect the women in the City, start with your two colleagues here," snapped Negron, referring to herself and VanWirt. Negron conveniently ignored a third female member of City Council, Grace Crampsie Smith, even though she was present and happens to support a wage history ban in some form.

"Please respect what we're trying to tell you and don't keep on talking down to us," continued Negron.

Callahan tried to respond, but Negron began waving her arms and shouted, "No you listen to me. ... You have to shut up, OK? respect us."

Bethlehem Gadfly has previously lauded Negron for "her willingness to work with others, her ability to change her mind — a trait not so noticeable in elected officials — her honesty, and her persistence."

Her antics at this meeting reveal the real Olga.

At some point toward the end of the meeting, Callahan wondered (perhaps not so innocently) whether Van Wirt's intransigence might be related to the fact that she has a business in Bethlehem. When she thought the meeting had ended, she stuck her finger at Callahan and threatened, "Don't bring up my business."

I thought it was a profession.

Doctor Van Wirt's behavior at this meeting was both unprofessional and hurts women. But she's a doctor.

(Blogger's Note: The County has no power to impose a wage history ban. I question whether a city government has this authority. )

Callaghan can be a horses ass at times but this time he was right on target. What a disgraceful show of arrogance and stupidity from two of our female elected officials. I am truly sorry I voted for them.

Bryan is his own worst enemy, and believe me, I have taken him to task on multiple occasions. But this time, I actually felt sorry for him. Van Wirt and Negron are allowing their disdain for Callahan get in the way of good government. As for me, I question whether a City government has the power to instruct private employers what they may or may not ask. Assuming that it does, I would want to hear from the business community before taking action, and would want to give them time. Perhaps they would agree. Perhaps not.

Bryan Callahan comes across as an arrogant condescending bully who does not belong in the chairmanship. Talking over and not hearing others out is just rude and is proof its his way or the highway attitude. His bandwagon fallacy of Philadelphia did it and its right for Bethlehem is just ridiculous too. The other argument of we need this done yesterday without seeking consensus is even more proof of his arrogance and weakness and lack of humility. I really abhor every one of these tactics and it cheapens your position.
I have no opinion on the ordinance. Is there somewhere to view this or did I miss the link? I do agree with you Bernie, why not seek input from the people it will impact? This is not good government in my opinion.

Wage gap is a chimera. Doesn't take key factors into consideration (time, inconvenience, risk, danger). My kids were sent to their rooms anytime they said, "shut up." I see four doctors and call each by their first name. It's fun to watch the politically correct practice cannibalism.

5:00, it’s not terribly complicated. The reality is that neither Negron nor Van Wirt was willing to offer amendments to address their concerns. Van Wirt is actually encouraging Callahan to conduct the people’s business behind closed doors.

I saw no evidence that Callahan was condescending or a bully. He talked a lot, to be sure. But he was seeking their suggestions and got slammed by two members. One told him to shut up. Another wagged her finger at him and insisted she be called doctor. And he’s condescending? The video shows the bullies, and it is not Callahan.

Agree that some of that can come into play when comparing wages of men v. women but I'm pretty sure when studied, the wages compared are of similar jobs... "every dollar earned by similarly situated men."

If I recall, when Bryan first introduced this Ordinance, he stated he discussed it with many women in professional positions. Van Wirt and Negron are mad that he did not include them.

Also, I am fairly sure that her blocking public from her Facebook page is illegal. Since she uses to engage on issues related to City government, she can't block people.

That was an interesting meeting. I agree with Callahan. He supports the ordinance as written, but is willing to add any amendments to it that the women on council want to include to "fix" the problems they have with it.

They insist he fix it to their liking without their input.

Nothing but a stall tactic or they are just lazy.

If van Wirt really cared about helping other women out and is as smart as she thinks she is, she would have come up with a "fix" to her problem with the ordinance in no time. Van Wirt is a Cancer in Bethlehem and people are getting to see her true nature.

If you read the story and watched the video, multiple courts disagree with you, and upheld the ordinances in other cities.

Furthermore, let me point out that there are MANY things that a prospective employer cannot ask on a job interview, and the municipality does not have to have an mechanism for paying for cases and lawyers. They are putting the protection in place for the person being interviewed, and the ordinance has multiple levels of notification to businesses within the City limits. If we follow the alleged thought process of these women, then no city should pass any protections or ordinances of any kind, if they aren't prepared to pay for the legal fees of potential victims. NONSENSE!

This has absolutely nothing to do with anything for these two except sticking it to Bryan Callahan, and they are arrogant enough to do so at the detriment of people in the city they should be trying to help however they can. These women showed their true intentions and they think women won't see through them. Well PAIGE and Olga, we do see now exactly who you are and what is important to you. PAIGE, you really showed us who you are behind the scenes, at the end when you thought the camera and mic were no longer on. You are vicious and spiteful and full of yourself.

Just to be clear, I agree that an employer should not be able to ask previous salary. But making it a municipal issue is crazy. Yes, there are many things an employer can't ask and that's a good thing but the City is not in charge of that. The State is in charge of this. What would be the incentive for a woman to go to a magistrate? The company pays $1000 or whatever to the City as a fine. The woman still doesn't get the job. Why bother? (I was a vp of HR so I do have some experience in this. ). I'm not defending any of them. To me, it's just a matter of priorities and figuring out what level of government should do what. And the meeting is five times longer than it needed to be.

I have been assured by several county officials that counties have no power to wade into these kinds of issues. I am unclear whether city government has this authority. It is true this law has withstood a challenge, but that was a challenge based on an infringement of commercial speech, not the basic question whether a City has the power to order a private employer not to ask questions about job histories. The challenge to Philly's ordinance is also a challenge to a first class city, which has considerably more powers than a third class city. It could be that a third class city like Bethlehem has this power, but I just don't know. I suspect Jack Spirk and Bill Leeson will be asked this question.

I know that when Pittsburgh passed an ordinance requiring paid sick leave, it was challenged in the courts and the state supreme court ruled that Pittsburgh (a second class city) did indeed have the authority under a state law giving cities the power to adopt ordinances to prevent diseases from spreading.

That was a bit of a surprise, so you never know.

These two ladies are either stalling this for personal reasons or are completely clueless. If this becomes the law 99.99 % of the HR departments and business owners will follow the law. We already have several issues that we can not ask prospective employees. In a City the size of Bethlehem, I would be surprised that 3 or 4 of these cases even end up at a District Justice. The logical thing to do would be to pass the law and thus protect the large majority of women from even being asked the question! But then again, I'm not a Doctor. SMH

Bernie, even if it turns out that a third class city does have the authority over this matter, I still find it questionable. Why would a woman go this route? There's nothing for her to gain. If she prevails, the employer is fined a thousand dollars (chump change) and the fines go to the City coffers. And that's it. Matter closed. How many women do you think would bother to go to a district magistrate? I do not know Paige, Olga or Bryan and so I do not understand the motivation for any of their comments and behaviors. My question is why are city elected officials even talking about this when there is so much for a city to do and improve. If council wants to improve the life of women in the city, get more women to run for office, get more women appointed to boards and commissions. If they want help in the realm of equal justice, fix the sidewalks and curb cuts for wheelchair users. These would be real contributions for city residents. Getting a Bethlehem business fined $1000 for asking for salary info doesn't do much for anyone. It just seems silly to me. If you want sue a company for discrimination, go to the PHRC, file a complaint, get a real investigation, and perhaps a valuable outcome.

Helene, I share your concern. Let's put it this way. I would want to hear from business and whether they think this is onerous. They may not think so. This is why I would oppose things like plastic straw bans without hearing first from the business community.

With respect to a wage history ban, it could be that most employers think it is no big deal. I do not know. I believe there was discussion about modifying the fine so that the $ went to the victim or her lawyer. Unfortunately, neither Negron nor Van Wirt was willing to offer an amendment.

Also, whenever a sidewalk is refinished, those curb cuts are mandatory, as they should be.

The City of Bethlehem has wasted tens of thousands of taxpayer dollars putting curb cuts where there are no sidewalks. Just check out, for example, Center Street and Macada Road, and Center Street and Johnston Drive. I have never seen a pedestrian at either of these intersections, much less one that needed a curb cut.

Stupid is not a big enough word.

5:09. I think the point is to just stop the businesses from asking the question. To stop basing my salary on what I made at my old job! It is documented that women are paid less than men for doing the same jobs, we have the right to make the same salary if all other things being equal. I just don't understand why these two women would try to stop this from protecting us in the future!
