Don Cunningham has resigned as Lehigh County Executive to take over as top dog at Lehigh Valley Economic Development Corp., where the pay's much better better and there are even Summer Hours. According to Express Times reporter Colin McEvoy, five Democrats want Cunningham's old job. One of them is Allentown Attorney Matt Croslis. But would he be the right fit?
Though his firm has been a clearing house for local Democrats seeking office, Croslis is doing his best to impress a very conservative Board of Commissioners that he's a kindred soul. One of them. Who knows? Maybe he listens to Rush Limbaugh. Better yet, maybe he's read Comm'r Scott Ott's Laughing at Obama. (available for just 99 cents).
He's also defending Controller Glenn Eckhart, an affable but ardent conservative, against DA Jim Martin's claim that Eckhart is ineligible to hold the office. That's worth a few points with 7 of Lehigh County's 9 Commissioners.
But what bothers me about Matt's application is the inordinate delay in a DUI prosecution filed against him last year. According to Lehigh County records, he was charged on 12/12/11 with driving under the influence, along with an assortment of other minor charges. But even though it is a first offense, the kind of matter that should be disposed of quickly with an ARD application, Croslis has managed to delay and delay it at the Magistrate's level. It was finally sent to Court on June 26, over 6 months after charges were originally filed.
On June 2, I asked Croslis to explain this delay. "[T]he delay makes me wonder whether the system is being gamed. I believe this is going to come out if you formally apply for appointment, so I would like to give you an opportunity to get your side of the story out there. I will probably note the charges, with no editorial comment. Is there anything you can tell me? Can you explain the delay?"
Just as every dog is entitled to one bite, I think every person is entitled to one DUI. In the case of an Irishman, maybe two.
But this delay bothers me.
Croslis promised to get back to me, but never did. That's a mistake. In an office that should be transparent, Croslis is intent on keeping us in the dark.
His "kick the can down the road" approach to problems would be a disservice to Lehigh County's citizenry.
Updated 2:00 PM: I just spoke to Matt Croslis. He decided that he would wait to answer my June 2 email until he decided to seek the position of Executive, and he only made that decision late last week. He told me he will be answering my questions. But as far as the DUI is concerned, he tells me there was no gaming. He applied for one continuance because he had the flu. The second continuance was by the District Judge. Croslis told me he has no control over scheduling.

Question: Does Croslis have a problem with alcohol and if so is this delay representatvie of his inability to deal with it straight away?
Hopefully not, so the folks of Lehigh County are not burdened with his denial.

Why should this well-connected "suit" get off when the Everyday Joe would be fighting for someone to represent him?
This is simply wrong.
If this guy won't respect the law before he becomes county executive...

It could be he doesn't want to talk to the press until he deals with it on the legal side. Still, I don't see how it doesn't come up during the Executive interviews, and he'll have to deal with it there if he hopes to get the job. Anything less than full disclosure won't sit well with the Commissioners.
It would appear that lost opportunities might be one price of his delay.

Six months is very unusual for a DUI, especially a first time offense that is going to ARD. I have no answer for you.
Well, maybe there is a legitimate, legal reason why there has been a delay in this. Your assertion, Bernie, that the system is perhaps being gamed is a big leap here. And there are probably good legal reasons why Croslis is not engaging with you on this matter.
DUIs are a LOT easier to get than most folks think. What the state considers intoxicated would shock folks who have never had to deal with the nightmare of a DUI. And the fall-out from these DUI charges can literally ruin a person's life.
Take this blog post, for instance. Let's say Croslis goes into the ARD program (assuming the BAC is low enough or the judge allows a lower BAC reading to stand) and his record is expunged after a year. There will still be an internet record, for ANYONE to find, that will haunt him forever.
It's a real shame. Croslis is a good guy. It's blog posts like this that make decent, normal people stay far far away from politics.

1. After the successful completion of ARD, Crosslis will be able to have his record expunged. There will be no Internet record (although officials will have it internally).
2. Agreed that there may very well be good reasons not to discuss the DUI, but my question did not address that. It addressed the delay, and Crosslis told me he would respond.

I just caught that. When someone seeks public office, the public has EVERY right to know EVERYTHING about that person's public record, including the fact that there is one. Like I said in my post, I do not consider a DUI, buy iself, that big of a deal. But there are plenty of people out there who do. You would deprive this segment of the public of public information bc Croslis seems like such a nice guy? Sorry, that does not cut it.

Easy there. Bernie's also done a puff piece ion Brennan to assist with rehabilitating his reputation. Brennan was a serial boozer-cruiser who has the gall to think he should debate drunk driving laws in the legislature, now.
Ironically, Brennan is exactly why drinking-driving morons should be LOUDLY, PUBLICLY VETTED. This guy won't vote on drunk driving laws. Brennan still does. Outrageous.

My money's on McCarthy for the position. He would be a good fit and the other commissioners know him pretty well by now.
DUI is a big deal, especially regarding elected officials and those who wish to be officials. Why the puff pieces on Brennan, for whom the story was mostly buried during the election cycle, and the question as to why Croslis is being granted a delay?
Eckhart is affable but has no qualifications to be the controller,unless you consider being a radically idealogical conservative.
He has no credentials in any accounting, audit, finance or management fields. He is simply a party operative.
The story concerning Brennan was by no means buried. It was the subject of front page news accounts in both dailies ... several times. My view is that a DUI, standing by itself, is no reflection on an individual's ability to serve, and that was the subject of what you cal my puff piece.

Like Barron in NC, Eckhart in LC presents a very real danger of being a political controller. I think Martin's lawsuit has thrown a monkey wrench into that plan ... for now.

Brennan has faced one, and only one, DUI prosecution. He quickly accepted responsibility for his actions, went thru a rehab, lost his license and entered ARD. He can at least blame his DUI on alcoholism. What is your excuse for your disinformation?
A DUI can cerainly have serious repercussions. But I know very few people who can honestly say they never drove while impaired. Ourt police are much more vigilant about this than in years past, and that is a good thing bc it keeps people alive. But I refuse rto accept the notion that a DUI, by itsdelf, is some kind of horrible crime.

B.O.,Just so you know it, I have a very good friend that was arrested in January of this year, thier "trial" still wasn't held and there was no delay on thier part. The court systems don't always go real fast! So just maybe he didn't delay it!! Maybe you should get your facts from the court systems and not from your mind!!!
Heh, heh. I am well aware that ARD is very fast for first time DUI. Usually, everything is done in a matter of three months. The preliminary hearing is waived, etc. This did not happen here.
