This behavior is repugnant to many lawyers because it's completely contrary to an ancient common-law privilege from arrest while at a courthouse, or going to or returning from a courthouse. This privilege is called eundo et redeundo. No less an authority than the United States Supreme Court has ruled that "witnesses, suitors, and their attorneys, while in attendance in connection with the conduct of one suit are immune from service of process in another.”
Though the common law has been abolished, courts have the inherent power to protect those summoned to appear before them.

The practice of courthouse arrests serves to dissuade certain groups of crime victims from seeking police or court protection. Think of a woman who won't ask for a domestic violence protective order if she fears a citizen-check by the Assistant DA. Criminals prey upon immigrant communities because the undocumented fear drawing attention to themselves from the authorities. That's because some of these immigrants actually recognize a police state.

ReplyDeleteTo arrest a human in a courthouse such as was done and, obviously orchestrated, was certainly ill-advised. It was a wrong move on the part of the agent for a multitude of reasons. The statement put out by the Philly Bar Association is inflammatory and hyperbolic.

Attempting to physically prevent federal agents from entering a county courthouse could be quite problematic and divisive. Making policy and/or basing a principle on the emotion which comes from a single, albeit, highly publicized, incident, which never should have occurred, is not wise. IMHO.
The common law has been largely codified, but it has NOT been abolished.
