Judge Morganelli Denies Injunction Sought By Pen Argyl Anti-Maskers

Pennsylvania's Commonwealth Court has invalidated a statewide school masking mandate from the Department of Health (DoH) because it exceeded its authority.  The mandate will nevertheless remain in place until December 4, and it could stay in place even longer if the state Supreme Court reverses. Jordan and Alissa Zahler, parents of two children in the Penn Argyl Area School District, have also sued over the statewide masking order, insofar as it is being implemented against their children. They were seeking an injunction that would require the school district to grant their children (and anyone else) an exception to the mandate for medical, religious or philosophical reasons. They also maintain their children should be free to ride maskless in the school bus. After a hearing, Judge John Morganelli has denied their request for an injunction. 

The Zahlers had previously been denied a medical exception to the masking mandate because they provided no medical documentation. Rather than just put on a damn mask, they actually yanked their kids out of school for\virtual learning because we all know that is so much better. At the hearing before Judge Morganelli, they failed again to produce any actual medical evidence to support their claim for an exception, although their daughter did once get anxious at the grocery store. 

Injunctive relief requires proof of "immediate and irreparable harm" without one. But it certainly appears that whatever harm is being inflicted upon Zahlers' children is being done by their own parents. They pulled their kids out of school rather than wear a stupid mask, and now their son is failing math. 

Parents of the year, those two. 

These folks never made it to first base.

You know how brainwashed you have to be fighting against a temporary inconvenience like mask wearing, implemented solely for the safety of your children?

it is time for vouchers so parents can pick the school that is best for them and their children, not a propaganda machine that teaches little children that there are more than 2 sex's and a helath class that advises kids to try all types of sex.

@2:48 - what school did you go to? Was it some right wing political madras in the area? Maybe a local Catholic school? Most likely a regular public school that you seem so happy to shit on - yet here you are, a pillar of the conservative community. Tell us how you survived and didn't become a tree humping bleeding heart liberal...

Why can't those at risk simply wear a mask that actually works -- an N95 or the military surplus M40 that offers nearly operating room level protection -- rather than pestering others to wear a flimsy paper mask offering not nearly such protection?

Personal initiative for one's own protection is all that is required.

I wore a mask and still got covid. My mask 100% failed.

I never said a mask is a panacea. I said and the studies show it offers some protection. I can add that most people do not wear their mask properly. ZIf I am at work and on a computer, I have to slip the mask below my nose bc my glasses fog up and I can't see. The other night, I was at a basketball game, and instinctively removed my mask when cheering. I actually got yelled at by security, but they were right. I don't want to give anyone a virus. Ihave to figure out some way to cheer with a mask.

@10:59 - are you dense or confused? A mask is not some force field and no rational individual would ever think it was - its simply a barrier, another hurdle in the way of the virus while you're out in public. Your mask didn't fail you, you probably didn't wash your hands enough, or a family member or coworker unknowingly had it and passed it along to you.

Its not rocket science people. Wearing a mask simply reduces the chance of spread - key word there is "reduces" not eliminate.

Like your Grand Parents (or likely Great Grand Parents at this stage for a lot of you) - they volunteered to fight a war, or if they stayed at home, joined the war effort in some way and saved and sacrificed, dealing with shortages and rationing. Its a battle that requires the effort of everyone.
