Tales of Trachta: Bail Conditions Relaxed For Sticker Gang

When Nazareth Police Chief Thomas Trachta chained, shackled and perp-walked the dangerous Sticker Gate for their Preliminary Arraignment before District Judge John Capobianco, located 50' away, he demanded some heavy-duty bail conditions. Though none of this trio had ever been charged with a drug offense (one was once charged with possession of drug paraphernalia), they were all ordered to undergo repeated drug testing. Another goofy bail condition is that they stay away from each other. Two of these Defendants are brothers who lived with each other. The net effect was to turn one of them into a vagabond, forced to sleep on a different couch every night. Freedom of association is nonexistent in Trachtatown, I guess.

On Friday, after a brief hearing before Judge Emil Giordano, those ridiculous bail conditions were removed.

"Is this the case I read about?" asked Judge Giordano..

"Stickergate," answered an attorney, and the courtroom started laughing.

There was no opposition from either the District Attorney's office or Pretrial Services. Not a single Nazareth cop in sight.

This is a brilliant tactical move by the legal dream team of Phil Lauer, Gary Asteak and Mark Minotti. By seeking relief in Court and getting it, they have sent a message to District Judge Capobianco. He should think twice or maybe even three times before taking any more recommendations from Chief Trachta.

  4. Capobianco listens to whatever the cops tell him- a very incompetent, feckless magistrate. I remember a hearing when he never let the defense atty. present his case- as soon as the cop was done testifying- he made his ruling-in favor of the cop. The defendant had 3 witnesses, who never had a chance to testify! The defendant didn't have the resources to appeal his ruling at the county level- A complete travesty! Trachta and Capobianco need to go!!

  5. I'll disagree here. He is pro-prosecution, which I would expect, but tries to be fair. Case in point are my next door neighbors who were charge with parking illegally on Main Street. He dismissed the case against them. I am sorry for your experience, but i think he tries to be an independent and neutral magistrate. In a preliminary hearing, if that is what you had, all the Commw. needs is a prima facie case. It doesn't matter what your witneeses say. I don't know the details.

  6. The fact that Bernie O'Hare is more concerned with drug dealers and law breakers should surprise no one. He attacks the tea party and any decent person who believes in the rule of law.

    Support your police department. O'Hare is showing everyone why he has the reputation he has.

  7. BOH and I often disagrees and he sometimes even deletes my posts (never because of personal attacks, by the way). But 9:32 is a friggin idiot. BOH is mostly fair and sometimes one-sided and often wrong, but I don't get the vibe that he's "for" drug dealers or law breakers. (That's a funny phrase.) These kids exercised their first amendment and were then the target of a strident abuse of power and a dickheaded police chief. BOH then exposed these other guys. I have no problem with that at all. The police need to be kept in check. Christ, look at the military gear they are wearing and driving nowadays. I believe this is a very critical time where the citizenry MUST be concerned with their local police departments.

    1. 954 having a job has nothing to do w being a druggie!!! Scum bag is a word used for many reasons. Pretty defensive there. Criminal mischief or defacing property is wrong regardless there are other ways to effectively make your points known. Look at all the people in front of diff usps stations against our world leaders. All about presentation the stickers was clearly a bad choice so whatever the punishment own up an walk away!

Also you continue to badger Trachta, Shwab, Troxell for their supposed wrong doings but praise the return of officer Fred Lahovsky ???????? Maybe your reader should google his name and see all the misconduct that surrounds his name........ You say that your attacks are not a vendetta on a chosen few but the more you say and post prove my theory correct!!!!

  10. That nmmight be a lot more impressive if an on-duty Troxell had intervened. Instead, several hours later, he swore out an arrest affidavit. I could have done that much.

    But an effort is being made to make him look good bc the Civil Service Comm'n is deciding tonight whether he rates higher that the #1 candidate, a lifelong Nazareth resiodent who served his country honorably in Iraqw and who is currently serving in a nearby police department. Trachta wants to blackbalkl the Iraq war hero in favor of a man who has bounced from department to department, failed in a lawn care business that he never registered and who is being sued by another police officer over unsettled debt.

  14. 3:36, Civil Service, which has as a member the wife of the council member in charge of the police committee. Very independent. The meeting is private or I would be there.

  17. One word NAACP need to get al sharpton on this because of the most important part the. Secret word being used to describe blacks al al al al al now he won't let the mayor chief or Dan troxell get away with this if black people are being sent to jail by these discrimination patrol and council scared to death I am going to get a good chance to talk too al in a month an enjoy a chance to show him what is going on 😈

Nazareth Borough is filled w old school prejudice people very sad n the seat i refer to is NOT Chief Trachtas chair before any tries to say that.
