I was in Judge Zito's Courtroom because I mistakenly believed that Jim Gregory's sentence was being reconsidered today. When I saw Mezzacappa, I was sure she was there to plead for her "significant other." But I had it all wrong. Gregory's case was not heard today. But Mezzacappa had her own matter on the list.
Some months ago, she sued The Express Times for libel as a result of a truthful and accurate article that Tom Shortell wrote about her. Recently, she decided that, while she was at it, she might as well sue West Easton Mayor Gerry Gross for libel, too. But rather than filing a new cause of action, she just filed the suit in with her suit against The Express Times.

Christine Schlottman, West Easton's Solicitor, knew something was wacky when she tried to enter her appearance on behalf of the Defendant. She was unable to do so because the only real Defendant, The Express Times, already had a lawyer. So she pulled the file and learned that Mezzacappa was playing games.
I can relate. On Monday, Attorney Orloski and I had to sit in Court for a motion that she never showed up to present. She uses the system to vex her opponents.
Today, Judge Zito grew irritated at Mezzacappa's very weak explanations for her failure to file or serve Judge Brenner's Order.
"The Court seems to be spending a lot of resources dealing with your procedural anomalies," he told her.
Denying her motion, he gave Mezzacappa a warning. "Having access to the courts is one thing; having access to the courts for unduly burdening your opponents with costs and appearances is another."
She tried to blame everyone else, but Zito knows her by now. "You are in a precarious position, Ms.Mezzacappa."
Mezzacappa has treated the judicial system like some middle school game for taunting and tormenting people with outrageous lies. The judicial system is no game. When she wastes judicial resources, as she has been doing, she is wasting the money of every taxpayer.

After being bounced out of court today, she sent my attorney an email, asking to meet him in the presence of a third party. She assureds my attorney that she deleted all the libel from her blog. But just a cursory glance makes clear that it's still there. That's what she does. She lies. Lie after lie.

Stop acting like people are always attempting to game the system. You have done that , well enough for not raising one cent of damages in any of your libel complaints, then coming forward after its over, to say you were fired from Patch, and you are owed 31,000 for 10 years of lost emplyment.

Second, your claims are based on separate occurrences. Judge Zito attempted to explain that to you, but I guess he must be wrong. He ruled against you, and he's the one sitting on the bench, not you.
Third, you don't have to worry about what I think. It is Judge Zito who made very clear that you are wasting the court's time. In fact, I am pretty sure he was toying with the idea of holding you in contempt.
Fourth, the only person here who has been fraudulent is you. That's why I have a judgment against you. Come December, the same court you have incessantly insulted at every turn will determine what you owe. And I will execute immediately. You continued the defamation after Judge Smith's opinion. Your proposed answer actually admits you acted maliciously. Your blofg is still loaded with defamatory comments, despite your lies to the contrary. I will ask for and get punitive damages.
Finally, the time for you to ask questions about my damages is over. That ship has sailed. We are going to court in December, assessing damages, and executing. All the insults you gave my attorney and me will be remembered.
But I am glad for your comment. It tells me you have learned nothing, and your "poor me" post was nothing more than crocodile tears.
Accordingly, I will instruct my attorney to forget any settlement with you and we will take the money we get from executing on everything you own.

ReplyDeleteHer anonymous comments here (note she can't sign her name) have made me realize she has no remorse and will continue to spew her hatred as much as possible. As Judge Zito correctly observes, she uses the system to harass people, instead of seeking justice. Numerous libelous comments are still on her blog, in defiance of the rulings against her.
Judge Zito may not have held Mezzacappa in contempt. However, I'm guessing he would be receptive to a motion for counsel fees and sanctions for vexatious conduct, including blatant violations of the rules of civil procedure. I urge the West Easton solicitor to file such a motion.

Clinton, I think that was meant as a threat, but it might be an innocent question. If I did not appear, I would get no damages. If Mezzacappa does not appear, we will struggle on without her, but no bench warrant would be issued. I would still have to prove damages.

The question of liability has been determined. As for comments, I am not responsible for comments that do not bear my name, but will anything that advocates violence.
