Republicans Ask Pa Supreme Court To Enforce Mandatory Date Requirement on All MIBs

Though November's election has pretty much been a red wave, incumbent Democratic Senator Bob Casey has an outside shot of snatching victory from the jaws of defeat once all mail-in ballots (MIBs) and provisional votes are counted and re-counted. Both the state and Republican National Committee are taking no chances. They have sued all 67 counties in the state supreme court and have asked that King's Bench powers be exercised to prevent undated MIBs from being counted, as some counties have already done. 

On Oct 5, the Pa Supremes ruled it “will neither impose nor countenance substantial alterations to existing laws and procedures during the pendency of an ongoing election.” On November 1, it specifically ordered that the mandatory date requirement “shall … be applied to the November 5, 2024 General Election.”

Republicans argue that changes in election rules adopted close in time to Election Day “themselves result in voter confusion and consequent incentive to remain away from the polls.”

Six counties (Bedford, Blair, Butler, Clarion, Susquehanna and Tioga) have filed responses agreeing with Republicans that undated or misdated MIBs must be rejected. 

Philadelphia, Montgomery and Bucks Counties have responded that rejecting these votes would violate the Free and Equal elections clause of the Pa. Constitution. They also argue that King's Bench powers are unnecessary because this matter can be resolved through the normal appellate process. 

Senator Bob Casey has intervened to state that undated ballots must be counted. And the Pa Department of State has asked to file an amicus brief. 

These are just the latest salvos in a judicial system that has failed to respond conclusively to the question whether undated MIBs should count fior several years now.

  2. I've often said Democrats are the experts at cheating. It's almost like they can't help themselves- it's in their political DNA. Their ultimate goal is one party rule as in China and they will stop at nothing to accomplish it. Fortunately, Trump has at least put a temporary hold on their efforts.

    1. I’m actually a registered R and I am not questioning the Supreme’s decision as this was hashed out earlier. These votes should not count. Period. But the rule seems non-sensical as it is impossible for the vote to have arrived late if it was received timely. Not even just postmarked, but received. Besides “its the law”, can anyone explain the rationale behind it?

  10. This race has been called by the Associated Press and Decision desk. Per the Democrat rules he is an election denier. Here is the playbook. Go to blue areas and get them to count the undated, unsigned ballots and get the percentage under .5% which buys you time to bring in Mark Elias. Then he goes judge shopping that allows illegal ballots to be counted. He did the same thing in the Al Franken senate seat. These people are gross. Receipt below

  13. The PA Supreme Court was very clear that ballots that lack required signatures and dates are not allowed to be included in official results. But you have election officials in the Philadelphia area counties that are willing to break the law. An official such as Bucks County Commissioner, Diane Ellis-Marseglia stated that "I think we all know that precedent by a court doesn't matter anymore in this country. People violate laws anytime they want. So, for me, if I violate this law, its because I want the court to pay attention." That statement should be grounds to dismiss her from her position. She is advocating anarchy. I hope her and any other elected official that is doing this are dismissed from their position and prosecuted for interfering in the election.

    This is a perfect example of why I don't trust the Mail in Ballots. That system should return to the pre-COVID system.

    1. Spot on. Thank you. Unbelievable that one can say I won't abide by the law so the court pays attention! And how hard is it to follow the simple instructions! It's a privilege to vote. It's a privilege to vote mail in. So follow the instructions and your vote counts. You don't change the rules by yourself in the middle of an election where the courts have already spoken. It's what our country is based on

It is just the latest in our Elected Officials putting their career's aside and finally tackle election integrity. Like most countries, there should be voter i.d. and mail-in only for military and infirmed individuals for a short period of time. This non-sense of drop boxes and insulting minority voters must end. The video of the Bucks County official bragging about breaking the law is classic- what an idiot!
