UPDATED: Trump Now Faces Criminal Charges on State AND Federal Level

In April, Manhattan District Attorney Alvin Bragg announced a 34-count felony indictment of Donald Trump for falsifying business records concerning hush money payments to two women. That case is incredibly weak. But now another shoe has dropped, with a few more very possible. According to USA Today, Trump faces a seven-count indictment for his mishandling of confidential documents, including nuclear secrets, that he carted off to Mar A Lago at the end of his Presidency. A criminal case means that, unlike other high office holders who accidentally took classified documents, Trump knew what he was doing. After all, he's a very stable genius. Just ask him. It also appears that Trump obstructed the efforts of federal officials who attempted to retrieve this sensitive information, which apparently even included contingency plans to attack Iran. 

In addition to these two prosecutions, Trump is being investigated for his role in the failed Congressional coup of January 6, 2020 as well as his efforts to persuade the Georgia Secretary of State to "find" the 11,000 needed to win in that state.  

One silver lining for Trump is that he's been indicted in Florida, not D.C., where he should have an easier time finding friendly jurors. 

He's going to be distracted. This is why I've told you that, despite the polling, someone else is going to be the GOP nominee.

  21. I voted for president Trump and I benefitted from his policies. I think we were a safer more stable country under his leadership. He was needed at the time. However times are different and I do look forward to a new option. Having said that and not knowing all the info as none of us do it is clear the system is broken and classified/declassified documents have left and probably continue to leave the chambers. So fix the system. Don't let people leave with boxes and then call them on it. Or be consistent with applying the obviously unclear guidelines. Biden Clinton. Etc there's no difference except it is a political witch hunt and a disgrace.   22. Generally, a "Witch Hunt" is a situation when there is a SINGULAR thread bare charge put up against an individual that is used as an excuse to impose a punishment desired by a mob.

    Two indictments so far, each with a long list of associated crimes and misdeeds. Trump is innocent until proven guilty of the charges, but the whining and complaining about the "Weaponization" of justice is comically embarrassing by those desperate to defend him. IF you do the crime, YOU do the time.

    Again, if proven guilty why should Trump be allowed to get away with committing criminal acts? If I start running for County Executive, can I then start robbing banks then complain about political persecution when the police show up?

    Most politicians are greasy and play in gray areas, surely profiting off of their position of power, but for the most part aren't completely brazen about violating laws that you and I must observe.

    I completely agree. If Biden absconded with confidential documents, and did so intentionally, he should be prosecuted. No one is above the law. My guess is he did not act intentionally. That's what makes noncriminal acts criminal. So does obstruction.

But, somehow, you think that logic can’t have any application here in the case of President Trump who did hold plenary power over classification of all documents, unlike Biden (and Pence) who did not have such authority.   69. Reading over the full indictment, the Biden Administration’s case in effort to convict Trump is heavily dependent upon 18 U.S. Code 793. Read that section carefully. Understand it describes actions taken in violation by UNAUTHORIZED persons in possession of such documents related to Defense Department activities. Keep an eye on this particular point as this kangaroo courtroom drama plays out. My expectation is these charges will be dismissed on appeal.

  71. This should be simple apply the military standard of managing classified, secret, and top secret documents. Apply it equally to all politicians. Apply it to all there worker bees. If a politician takes any of those documents and shows them to anyone without a clearance they should be in jail. If they take them outside of a document controlled area they should be put in jail. If they keep them beyond their time of use they should be put in jail. If any of their worker bees do anything with those types of document without proper authority then put them in jail. And utilize the 5 year imprisonment law which Trump initiated as the starting point for time in jail. Then multiply it by the number of documents they took. Ignorance of a low is not a reason to get off. So make it simple apply it to and start jailing all of them immediately.

  81. For those interested in reading actual facts about these charges, become familiar with our Presidential Records Act and court opinions registered in previous challenges. Interesting stuff, particularly the challenge made in 2012 by the group, Judicial Watch.

    The problem we have these days is a two-tiered system of justice, and major news media that (too often) bends and censors information for political reasons. Viewers, listeners, and readers are being “played” as youth of today frequently refer.

    Truth is out there for the taking, but increasingly difficult to find. This takes time and effort well beyond what most are willing to commit. Much too easy to just repeat what someone else claims. One example is the matter of election integrity, so often ignored on purpose.

    No, I am not registered Republican and haven’t watched Fox News for more than a year. I did vote for Trump twice and will surely do so again.

    Use the internet to find smaller news outlets that back-up what they claim with unedited documents and untouched photos and videos. Such sites ARE out there. Lots of reading involved, so if that’s not your thing, you won’t gain much of any use.

They have numerous flaws, and yes, there is a detectable anti-Trump bias. But this is what happens when someone constantly attacks them as fake. I admit my biases. I never pretend to be objective. I provide the truth, but it is the truth as I see it.

    I called the Manhattan indictment a political prosecution, but the federal indictment of Trump is damning. There just is no way around it. It is replete with example after example of his total rejection of the rule of law when it is applied to him. He actually encouraged his own lawyers to lie. He must be held accountable.

I scroll right through that to the second page, if necessary. Well worth checking out for those who want to see SOLID evidence, not just claims.

Of 30,000 emails, three were classified. None was top secret. The decision against prosecution was based on the conclusion that there was no criminal intent and it would be difficult to convict. And it would be. But I remember the constant "lock her up!" cries during the 2016 Presidential campaign. Her failure cost her the election. She was fined $113,000, not $8,000, on an unrelated matter. The first part of your name is very appropriate.

    In this case, Trump brushed off National Archives, grand jury subpoena and a visit from DOJ's top counter intelligence official. He moved documents to hide them from his own lawyers. He suggested his lawyers lie. This is willful retention and obstruction. It is criminally reckless behavior. This occurred in spite of efforts by DOJ to give him every opportunity to return the documents.

    And yes, the documents in question included nuclear secrets, contingency attack plans and other classified material, as Trump's own audio recordings make clear.

    He is entitled to a presumption of evidence.

Those who took the time to read the Presidential Records Act and various court rulings pertaining to how it has been applied will note that President Trump (and all other Presidents have unconstrained authority in determining how such documents are handled. He alone determines, not Congress, the DOJ, nor the National Archivist, which documents to keep, when to move them, the timeline to submit whatever documents HE chooses to provide to the Archives.

    Read the Act for yourself if you disagree. Seems to me, this will be a key part of his defense against these charges. If these points are not upheld, you can count on many future appeals that could well drag out until after the next election.

What is alleged is that Trump willfully retained defense information. He actually showed it off to third parties. He engaged in witness tampering. He falsified records in a federal investigation by misleading his own attorneys, which cause them to attest falsely that all records had been turned over.
