FBI Search of Trump's Florida Home Mar-a-Lago Requires An Explanation

On Monday, more than 30 FBI agents descended upon former President Donald Trump's home with a search warrant (it's sealed) obtained from a federal magistrate. Trump himself has been at his Bedminster residence to escape the stifling Florida heat. This begs the question why 30 agents were needed. It certainly is troubling. I don't like Trump, not one little bit. But if they can indulge in this type of overkill for a former President, imagine what they can do to you or me. According to WashPo, agents were looking for Presidential records that Trump failed to provide the National Archives in defiance of the Presidential Records Act. If so, shame on him. But it's hardly a matter that requires a search warrant and 30 agents. If that's all there is, then the complaints I've heard from Republicans are warranted. But is that all there is?  

An explanation is required. If this warrant was obtained just to grab Presidential records, even classified records, the FBI is off its rocker. No search warrant has ever been executed on a former President. But if records are being sought in connection with the January 6 attempted coup, the action taken might be justifiable. 

I think we are owed that explanation. I believe there are two possibilities. 

1. The FBI may have had information that Trump held on to sensitive classified documents, and there was a real concern that they could be leaked to a foreign adversary. If this is the case, I believe the action is appropriate.

2. The FBI is investigation the January 6 attempted coup, and obtained a search warrant for Presidential records as a pretext to look for evidence implicating Trump in the attempted overthrow of Congress. If such evidence is seen, it can be seized under the plain view doctrine. If this is the case, I think the FBI is playing games and is acting in bad faith. 

Whatever the reason, I do think we are owed an explanation.

  1. My read on this is, several weeks ago it was in the news that about 15 boxes of material was in Trump's possession that were believed to contain materials that belonged in the National Archives. I remember these reports. Then we heard in the last few weeks that Trump's lawyers have been in discussion with the DOJ.

    I believe this is a case of those 15 boxes (still reported to be 15) were not turned over. So to me, this raid makes sense. The Archives wants their materials, has not received them and they aren't waiting anymore for compliance. End of story.

The FBI and other agencies have been politicized for years, they are now becoming arrogant and unrestrained in their ability to use the power of the federal government in an attempt to limit the former president from running again for elected office.   7. As far as I’m concerned, that raid on the home of a political opponent is an outrageous and disgusting act that should concern ALL citizens. This was the action of a police state tyranny.

    The people who ordered this raid MUST be identified and punished. This is a rogue government action that took careful planning over several days and done at the orders of some high officials of the current administration. We do not need another 6 month long investigation that leads nowhere. The chain of command here is not so deep it can’t be revealed quickly. Identify who ordered this and take REAL punitive action. Not just more sternly worded letters.

The Bidens should start burning all their evidence immediately, because mom's compound in Wilmington will certainly be raided after Joe's presidency. This is how third world countries operate. We've let the third world waltz into this country unmolested for two decades. That they control a political party and running a justice system like a banana republic should surprise nobody.   9. News outlets have been reporting that their sources are saying the search was related to the Pres Records Act, but why wouldn't a search warrant and 30 agents be required? Mar-a-Lago isn't a small home, or an apartment. A Judge was presented with sufficient evidence that a search warrant was necessary.
    This isn't the first time that tens of agents were used in moving on a search warrant conducted on a private citizen.
    Garland is no fool. He wouldn't have moved on seeking a search warrant unless there are documents so sensitive that they can't be risked being retained in the possession of Trump.
    On the bright side, maybe they find Trump's heath care plan he told everyone he had, when he was still President.

  11. They have there AI equipment turn our dumb phones gps tracker on when I turn it off daily? I am an American citizen and of no threat whatsoever to American sovereignty. I have never signed on to this with my carrier or the government?
    They should be watching the people crossing the border that the USA have given prepaid phone too! Most are good people fleeing bad countries while they are also letting terrorist pass through too.

  12. The "if it can happen to Trump, it can happen to you and I" line is the wrong perspective in a constitutional republic. In "a government of laws, and not of men," as John Adams referred to us, if it can happen to us, it should be able to happen to Trump. Our leaders are not teflon, and no one should be above the law. In the end, its an executed warrant that no doubt still did get extra scrutiny because of who the subject was. However, not pursuing because of fear of the subject's "followers" would be the criminal equivalent of a heckler's veto. As to the number of agents, it's not like they were searching our humble dwellings and only needed a few agents.

    He can list what the FBI was searching for and deny or acknowledge having such items.

  14. I get that every time a Republican pops up as a viable POTUS candidate that he'll be targeted by the current administration. This started with Obama investigating a POTUS campaign over his party's nominee's now discredited Russia hoax. She had national security stuff on a home-baked server that Guccifer hacked five or six times to demonstrate how easy it was. She still hasn't been investigated. That's home team advantage. But that's where the weaponization of the DOJ began at the POTUS candidate level. Trump is the latest because he might actually win the election if held today. He won't be the last. That's why DeSantis is R's safest bet to avoid this new, new. Rs don't have friendlies in the DOJ and it will take them a while to concoct their revenge - which will certainly come and will be harsh. Ds never complain about Citizens United after figuring out how to kill Rs with it. That's how politics work in our post-democratic republic. It's unseemly. But it's who we are and we've never been any better than this.

  16. So the Judge that signed off on the warrant previously represented associates of Jeffrey Epstein, the "Judge" set up a defense firm after he resigned as a prosecutor for southern Florida.

    "Reinhart assumed his role as Kellen and Marcinkova’s attorney once he set up a criminal defense firm after resigning from his post as a senior prosecutor in the Southern District of Florida as it was negotiating a non-prosecution agreement for Epstein. Reinhart would officially begin his legal representation of Epstein’s accomplices within days of leaving his position as a senior prosecutor within the district."

  17. New York Post has reported the FBI agents were in the Trump home for more than 6 hours. They also refused to allow Trump attorneys inside to observe the operation. Worst of all, Melania’s personal clothing in a bedroom closet was picked through, including her undergarments.

    At this point, who can deny the possibility of planting evidence and listening devices throughout the home?

    This is an historic abuse of power by the DOJ and FBI, I think. Big change needed in both.

  18. Another interesting aspect of this is the WH claim that Joe Biden didn’t know anything about the raid.

    I’m reminded of Mark Russell’s joke about Ronald Reagan during Iran/Contra:

    “It’s not just ‘what did he know and when did he know it?’ It’s not even 'what didn’t he know and why didn’t he know it.’ Maybe the real question is ‘what does he know and does he know that he knows it?’”

    Of course, typical PBS viewers probably wouldn’t find that funny these days.

  19. IF and its a BIG IF, this is politically motivated fishing trip, then yes it is a horrible development in this country, but a couple of points...

    The FBI Director and the Judge granting the warrant were Trump appointees so there is a likelihood of fire to go along with a lot of smoke here.

    Merrick Garland and DOJ have been extremely tight lipped on J6/Trump investigation to the point of a lot of left wing loonies declaring conspiracy theories of their own, but the DOJ silence could simply be them doing their jobs and not tipping off who/what is being investigated. I believe Garland has been overly carefully to recognize the polarization in this country and has set high bars in his investigation.

    While the FBI legally cannot make the warrant public, I believe Trump has his own copy of the warrant, and can release it if he wanted.

    I do think the "if they can do it to him, they can do it to us" line of reasoning is mildly overcooked in terms of a talking point/threat/scare tactic. How about just keep your nose clean, stay out of shady areas and be a good person then maybe you won't have your home raided by FBI agents?

  24. I agree completely with those who say no one,not even Trump, is above the law. But I am also well aware that the FBI can and has abused its authority on multiple occasions. Why 30 agents for documents? Could not this have been handled in a less intrusive manner? Trump had already turned over 15 boxes of records. He was cooperating. Now if something came up that made agents fear that he was in possession of documents that could be leaked (or stolen) by China or Russia, I get it. But we deserve to know this. The person who said that warrants remain under seal is incorrect. The DOJ could easily get an order unsealing the warrant and supporting affidavit. It is true Trump could release the warrant, but he does nbot have the supporting affidavit.

    Those who claim this is political or comes from the Democrats have offered no evidence to back up their accusations. Only conspiracy theories. This does concern me, however, as a possible abuse of federal authority. It happens. This has happened to ordinary people at times. Once you are in their sites, you are toast. This did happen to a good friend of mine.

    Trump has been insulting the DOJ and FBI for several years now. It's obvious to me they have it in for him by now, and I can't blame them. But they are supposed to stay above all of that.

    If this is a pretext search used to justify a six-hour fishing expedition, they should be sued. If they were looking through Melania's personal clothing, which I don't believe, they should be sued.

    By the way, you don't announce a search warrant. You have no obligation to allow a lawyer to be present. If there is concern that Trump was in possession of documents that could fall into the wrong hands, I support this action. Absent that, it is overkill and an abuse of federal authority. No one is above the law. That includes Trump. But it also includes the FBI.

    I noticed the FBI association has a spokesperson named Brian O'Hare. He obviously comes from the more aristocratic part of our clan. My family comes from the part that was kicked out Ireland for making bad whiskey.

  28. Some are using the term 'Gestapo' to the vexation of others who counter with the atrocities the Gestapo committed. Fair enough. This isn't the Gestapo. But, declaring war on your political enemies was indeed a Gestapo tactic.

    The Gestapo was formed as a state police force, not a "killing people without trial" force. That came a few years later. There was an act passed that allowed the Gestapo to operate without oversight from any judicial branch. The ruthlessness and crimes against humanity came after that.

    We aren't at the "killing people without trial" part yet but we seem to be at the "no judicial oversight" part. "No person is above the law" is code for we can infringe upon your rights anytime we want.

  30. Trump should be treated like anyone else. The DOJ does not hold press conferences about its investigations--Comey's transgressions being a wholly inappropriate exception.

    That Trump World is claiming, without evidence, that the FBI planted evidence tells me that the FBI has seized incriminating evidence. If so, I hope the DOJ prosecutes.

  34. Given that a search warrant executed against a former President of the US is wholly unprecedented, we need to know why this happened. There are five Congressional Committees with oversight powers. The feds can do this the easy way or the hard way. If it is a pretext search, it is entirely improper. If there was a legitimate concern that sensitive material would fall into the wrong hands, it is justified. Why 30 agents? Why Melania's wardrobe? This has a foul odor about it.

    Trump received a copy of the search warrant Which I can not find any release thereof. I do not believe the FBI can release it nor in this situation do they want any leaks of it. Search warrants can be a matter of public record however if there is sensitive information in them then they can be sealed for a period of time. If Trump truly finds it heinous then he should release a copy of the search warrant. It would answer so many questions.

    Him not releasing the search warrant just makes me wonder if this is another blow hard moment for him like complaining about so many things and not showing any evidence of what he talks about or action on what he said he would do.

Trump could publish the warrant and let us all know why the FBI was there, but that would stop all the criticism and speculation by the forever Trumpers and he would loose the spot light. He can get a few days of media out of this so he’s going to keep it going. Obviously, he removed records from the Office of the President. He didn’t respect the office when he occupied it, so why should he respect the laws of the Federal Archives? Or was he planning the collection of the Trump Presidential Library? LOL

  45. All of us are doing nothing more then speculating and showing how ignorant we can actually be. We know not the reason for the search (And it was not a raid). We know nothing other then a search warrant was granted. We think we know who approved it but we do not know for sure. We are already condemning it when it might be fully justified or absolutely a farse. Some of us are defending a confirmed liar, thief, tax evader, con artist and number of other things. Other are condemning the same person deeply and completely. Granted the picture does not look good but we do not know any6 real facts yet.

    Some are crying witch hunt but yet at the same time demanding a witch hunt of those who executed the warrant. And of those who so many are certain are involved but have no knowledge of whatso ever.

    Yes it is a travesty that the world and this country has gotten to this point but we need to let let it play out.

Do you, say, expect an FBI agent to admit that they didn't really care about the documents that were improperly taken from the White House by Trump but just wanted an excuse to find stuff on other matters, such as J6? And probable cause to search for documents is probable cause to search for documents, right? (And, as you say, "plain view.")

    Maybe Trump had one box labeled "Documents that I took from the White House in violation of law" and another that says "Stuff that I didn't take from the White House in violation of law but that incriminates me with respect to the Capitol coup attempt." How about a third box labeled "Incriminating stuff I burned long before the FBI got here and so it's empty"?

Hunter leveraging his fathers political position for personal gain via a foreign actor attempting to influence American policy? GUILTY!!! Did Trump and anyone from his family do the same thing?     The Clintons, Bushes, Obamas and Bidens have ALL suffered political attacks for various ethical and morally poor choices. What separates Trump & Co from them is the brazenness of the actions and demonstrable disrespect for the laws of this country.

  53. Bernie - you keep mentioning the fact and seem to be quasi offended that the FBI used 30 agents. My guess is that because of the size of the property, securing search areas and the amount of time needed to conduct the search (I don't think a warrant allows for an open ended occupation of the property) that was simply the calculated manpower required to conduct the size and scope indicated in the warrant.

    Sending in a small handful of guys to conduct the search of a 63,000 square foot, 125 room mansion seems a little silly when you think about the logistics.

    Not even close. Abortion was overturned as a made-up constitutional right, and 2A has never been on firmer footing. I never liked Trump. But I liked the promises he made and kept.   72. 1) The current FBI director was appointed by Trump. 2) A federal judge had to sign off on the search warrant. 3) Trump has a copy of the search warrant. if he has nothing to hide then why doesn't he put it out in public so everybody can see what is in it?     Chris E, Comments that question my decisions about comments being published are themselves subject to deletion. I, and I alone, make those calls. But I'll respond.

    First, I deleted a large number of comments far worse than those you see.
    Second, there are times when I allow some of the more ridiculous comments to show readers that there really are some people who are off the hook. When I point out that some MAGAs are racist, homophobic and sexist, this proves it.
    Third, I leaned towards allowing some of the venom because the MAGA crowd is very angry over this seemingly unnecessary raid (and yes, it was a raid). We all should know this.
    Fourth, if I wanted lots of comments, this would not be a local blog. I primarily write about what goes on locally. If I wanted lots of comments, this blog's title would be different. My whole focus would be different.
    Fifth, the best way to counter hate speech is by confronting it.

    I have no desire to make this blog seem like anything more than what it is. It is not monetized and I don't care if I have 10 or 10,000 readers.

  106. 6:56 A raid is the execution of a search warrant with the element of surprise because there is a reasonable likelihood that the people and place to be searched will use force to resist the search and/or destroy potential evidence. So, a search warrant has to be issued before a raid can occur. But the execution of a search warrant does not always require a raid, such as in the case of the defendant already being arrested and then a warrant is given to search the person’s vehicle that was parked near the scene of the arrest (eg, a hotel parking lot).

    So using that and your logic I think the FBI missed the opportunity. They should have broke out the crash wagon, rounded everyone up on site until they could prove who they were and not involved, ripped out walls, shot the place up, used the water cannons to fight back the trump supporter crowds, and arrested anyone with a weapon in or near the place. Now that would have been a raid that would go into the history books.
