Spitale Clings to Two Vote Lead in Palmer-Forks Magisterial Contest

I told you that Lehigh County received 395 provisional ballots in last week's municipal primary, of which 209 were fully or partially counted. It is likely, therefore, that Northampton County received a slightly smaller number. The tallies from these provisionals have yet to be loaded to the county website, but couls swing the Democratic nod in the race for Magisterial District Judge in Palmer and Forks Tps. Atty Lisa Spitale clings to a two-vote lead over Attorney Susie Hutnik.

    Pennsylvania Statutes Title 25 P.S. Elections & Electoral Districts § 3168. Tie votes

    In the case of a tie vote not otherwise provided for by law, the candidates receiving the tie vote shall cast lots before the county board or the Secretary of the Commonwealth, as the case may be, at 12 o'clock noon on the third Friday after the election, and the one to whom the lot shall fall shall be declared elected.  In any case where the fact of a tie vote is not authoritatively determined until after the third Wednesday after the election, the time for casting lots shall be 12 o'clock noon of the second day after the fact of such tie vote is authoritatively determined.  If any candidate or candidates receiving a tie vote, fail to appear before twelve o'clock noon of said day, the county board or the Secretary of the Commonwealth, as the case may be, shall cast lots for him or them.  For the purpose of casting lots any candidate may appear in person, or by proxy duly appointed in writing.
