Mezzacappa Against Morganelli

You own views are appreciated, especially if they differ from mine. But remember, commenting is a privilege, not a right. I will delete personal attacks or off-topic remarks at my discretion. If she has unlimited funding, wouldn't she have had a better legal team in your prior encounters? That part has me most puzzled.

This must be a violation of some sort of code. Is there a constable associate or oversight board of some sort? This person is clearly deranged.

ReplyDeleteI respect you, and as a Constable I don't condone her hateful speech towards Morganelli or anyone for that matter but her speech is protected under the constitution.
For the record, I don't wish to be viewed as a "Cop" I wish to be viewed as a professional Constable. Please don't group us all together with your comments.

ReplyDeleteIf she'd used this expression on a personal facebook account, one that did not clearly state that she's a constable in the heading, then PERHAPS it'd be protected speech. But the PA Supreme Court says that constables must comply with the UJS Code of Conduct, which prohibits EXACTLY this. It is entirely inappropriate for her to express opposition to a political candidate as "West Easton Constable" or whatever her heading it. And her disgusting homophobia isn't up to the code either!
"Constables must comply with standards of conduct established by the Unified Judicial System, which require that they avoid conflicts of interest and abstain from soliciting funds for any purpose or engaging in political activity while performing judicial duties."

ReplyDeleteI don't condone the context of her speech, it's wrong and even worse to do so as the title of constable on her official social media page...I DO recognize her right to free speech as I do others. In respect to the UJS policies, she isn't performing any judicial duties when she is making those statements, We are also not judicial officers...the rules apply ONLY when performing a judicial duty (paper in hand from court, transport or other function we are getting paid for by the courts) We can also campaign for ourselves and others as long as we aren't doing so while performing judicial duties for the courts.
Again I don't agree with the wording of her speech or that she did so as a constable.

Its apparent this woman is deranged and the mere thought that she carries a gun and has the powers of any type of law enforcement official or is an elected capacity is off the charts. God help West Easton Borough! This woman needs to be evaluated mentally for sure. The community is at great risk with her in office.

ReplyDeleteFred, The public perception of constables, as you must know, is that they are out-of-control, frustrated, wannabe cops. I know many constables and know that most, including you, are very professional. And you have a tough job. But there are just enough loonies to make me think the office should be abolished. And while Mezzacappa has free speech rights, she made these comments holding herself out as an official constable. I am surprised that, instead of defending her right to be a monster, you are not asking the constable review board to direct that she be given no work. Hence the public perception continues.

ReplyDeleteBernie - I agree in part. The Constable Review Board (CRB) does not have jurisdiction over this with her comments. The CRB only has jurisdiction involving constables performing a judicial duty pursuant to the complaint.

ReplyDeleteObscenity is a matter of taste, and defamation has to be reasonably believable. If it comes from a person who for example, is a known liar, or otherwise publicly known to be impaired, unbalanced or unbelievable, as may be the case here, in becomes harder to prove damages.

ReplyDeleteThis post is about Mezzacappa, not Trump. Trump most definitely is an embarrassment. The stock market is tanking, unemployment is up, the economy is slowing, we have been alienated among our closest allies, other countries have no reason to trust us, unnecessary trade wars, eliminating protections that keep us safe, and a disgusting mouth from the Tweeter-in-Chief.
