Even Stewart Early, a thorn in Atiyeh's side in previous zoning requests, told Atiyeh he was pleased.
Although zoners granted Atiyeh the necessary variance, it was conditioned on his agreement to withdraw a multitude of other appeals for residential treatment centers, including one to be located right by Bethlehem Catholic High School.
But then Atiyeh decided to appeal the decision, even though it gave him precisely what he wanted. That's because Atiyeh believes zoners have no legal authority to force him to withdraw one set of zoning appeals in order to get relief in an unrelated request.
Now Bethlehem has fired back.
On August 24, the City decided to appeal the Zoning Hearing Board's decision, too. Bethlehem's new zoning ordinance which the administration supported, provides for treatment centers like the one at 825 12th Avenue. So essentially, the City is challenging its own zoning ordinance.
So Atiyeh is appealing a decision giving him the relief he wanted while the City is challenging its own zoning ordinance.
Does any of this make any sense?

ReplyDeleteNo, the City can't condition an approval on the withdrawal of other proposals, but that's what the "gentlemens agreement" was. Now Abe (instead of actually building one of the few things he manages to get approved) just wants to be a spiteful child and play more games.

Correct me if I'm wrong.....But doesn't the Mayor have the final say on whether this gets appealed or not. Just curious. If that is the case, why is Callagahan doing this? Is pay back a bitch? I guess I just don't understand government.
ReplyDeleteif you attended the meeting, you would know that Abe Atiyeh made the commitment to the ZHB to withdrawal the plans without a request being made by the ZHB. It was a promise he made to the Board, the neighbors and the City. Now he is going back on his word. COngrats to the City, its lawyers and the Mayor for trying to hold this guy accountable for his promises. Amazing that his partner is the solicitor to the zoning hearing board.

Anon 5:15 you are right. Stoffa did indeed commit to help out Atiyh early on. He eventually worked out a sweetheart deal that promises Abe big dollars over a long period of time.

Go Abe Go!. He is right and he will prevail on the appeal. They cannot force him to withdraw other plans. Yes he can agree to withdraw the plans, but they cannot require it. Everyone hates Abe but he is fighting for what is right. Someday I want to meet my 3 biggest hero's on this blog Bernie(BO), Ron Angle, and Abe.

Tossing a naked angry drunk out of your home on a summer weekend is the sure way to accomplish it.
Then, proceed to open your own blog to tell the devastating truth about each and every ticky tacky detail.
I have done this and done it well! I think I may be in the running now for the most viscious and vile recipient of his hate....

ReplyDeleteOver 6 years of blogging, there has been a group of people who have tried their best to shout me down. They've posted outright lies, have started imitation blogs and have actively encouraged others to stay away from me. Of course they are almost always anonymous. They like playing in the dark, and hate it when someone exposes them, so they must shout me down.

Tricia Mezzacappa is a person I exposed as the Wicked Witch of West Easton.
She believes that she can con people by telling the same set of lies over and over. She can't, and has destroyed her own credibility by posting accusations proved to be lies. She has engaged in defamation in an attempt to draw me into ridicule, and I have sued her and insist on compensation for the damages caused. She has made death threats to a West Easton official, and has been charged criminally for that.
There are usually 3 sides to a story--his -hers and the truth. right now after seeing how she acted at the West Easton municipal building and reading the police officer 's report; plus taking into consideration the many calls to the police about one thing or another, I have to believe the truth leans more on the side of O'Hare. Sorry Tricia but i believe you need help or you need to move.
ReplyDeleteYes, it does make sense. What does one zoning matter have to do with another? Really??? This shouldn't become a poker game where all the interested parties get to ante up and make their 'gamble'. This is supposed to be public policies...
