Pennsylvania is a "shall issue" state, meaning that anyone who applies for a permit to carry a concealed firearm must be approved, unless the Sheriff can prove the person is legally disqualified by virtue of a felony conviction, active Protection From Abuse Act Order or recent commitment.
Yesterday, Northampton County Sheriff Randy Miller informed Mezzacappa, "[Y]our license to carry a concealed firearm has been approved and you should be receiving it today or tomorrow."
Mezzacappa has celebrated by publishing a very bizarre video depicting scantily clad women holding and shooting guns, NRA emblems, Marines, herself, her pig and a coffin. The video ends with a picture of West Easton Borough's webpage.
Mezzacappa recently stated, "I may love to see a delicious hockey puck smash right through O'Haters mouth, and out the back of his skull.......wink, wink....joking, of course!"
It's very reassuring to know she was just joking.
And now she's packin'.
Updated 12:15 PM: Sheriff Miller asked to reconsider. - I have sent Sheriff Miller this email:
On 6/12/12, you emailed Tricia Mezzacappa to tell her that her LTC has been approved. I understand Pa. is a "shall issue" state and you have little discretion. But if it is not too late to deny this request, I ask that you do so.
Item 37 on a LTC permit application asks the applicant whether she would be likely to act in a manner that is dangerous to public safety. Mezzacappa has recently filed pleadings in my defamation action against her that indicate she would be dangerous if allowed to carry a concealed firearm.
In this pleading, she states "I have had to seek medical attention to properly handle my anxiety, fear and stress. It is the opinion of my physician, that I must be sedated with medicines that are included on the Schedule of Class IV Controlled Substances , for all matters involving Bernie O'Hare, to quell the situational anxiety I have suffered at the hands of Mr. O'Hare. It is my opinion (as a Registered Nurse of 10 years), that due to the potency of this medication, I would be unfit to stand trial, or provide my own defense pro-se."
If she considers herself incompetent to stand trial, how can she consider herself competent to carry a concealed firearm?
I realize your discretion is very limited and it is probably too late to bring this matter to your attention. But I am concerned.
So are West Easton Borough officials. In response to what Mezzacappa must consider good news, she uploaded a troubling video to youtube yesterday. It features scantily clad women firing guns, along with a coffin and finishing with a reference to West Easton Borough web page. The lyrics are about some kid who has found his father's gun and "he's coming for you, yeah, he's coming for you."

ReplyDeleteWhen Mezzacappa's slideshow is viewed and listened to in context (Mezzacappa's well-known contempt for West Easton officials) she seems to have crossed the line into Terroristic Threats.
PA Crimes Code Section 2706 states: "A person commits the crime of terroristic threats if the person communicates, either directly or indirectly, a threat to commit any crime of violence with intent to terrorize another."
DA Morganelli should be asked to investigate this perceived threat as aggressively as he investigated the two threatening blog comments about Judge Koury in February of this year.
At the time Morganelli said: "A defendant need not have the specific intent to terrorize...so long as the evidence shows even a reckless disregard for the risk of causing terror." Morganelli said the language chosen by the online commenter "caused Judge Koury to be concerned about his personal safety."
That is true and i believe that the person who threatened Judge Koury should have been prosecuted, notwithstanding Judge Koury's willingness to let the matter slide.
ReplyDeleteJohn Morganelli is a First Amendment purist. I say this with admiration, by the way. Over the years, he has maintained a very consistent view that the First Amendment is very broad. Whether it is leafleting outside a post office, flying a flag upside down, criticism of him, political campaigns or speech that may cross the line, Morganelli will err on the side of allowing speech. He and I have had discussions about this over the years. It is rare to see a DA who defends the First Amendment like him, but I kinda' like it. Still, it worries me when I see something like that video.
Bernie, I used to work for newspapers and I am a First Amendment purist too. But threats of gun violence against public officials (remember Congresswoman Gabby Giffords?) go too far. Please re-read John Morganelli's 9-page statement of February 27, 2012 regarding the Judge Koury case. The DA said: "When legal free speech turns into threats against an individual, the line is crossed and a crime has occurred." If the comments about the judge crossed the line, then this video, in context, also crossed the line.

She frequently disrupts meetings there. Boro officials have had to install cameras and request a police presence bc of her. She also recently visited Easton City Council to complain abut them answering my own RTK requests and I do not believe there is a policy there concerning guns.

On many, many occasions - verbally and in writing - she has expressed intense animosity for certain officials. She has engaged in repeated name calling, profanities, ridicule, false accusations and belligerence.

She identifies herself with the sexy women in the video who are brandishing handguns. Her target: West Easton officials, which is the only explanation for the final slide in her slideshow. The lyrics of the song add to the threat that she's "coming for you...better run, better run faster than my bullet." Clearly, she's sending a message. I'm not a Borough official but if I were I would be concerned about my personal safety, just as Judge Koury was concerned about his personal safety.

And let's further assume that he posted a similar gun video over the lyrics "better run, better run faster than my bullet" and that his video ended with an image of the Saving Gracedale site or the Mezzacappa blog. How loudly do you think the Saving Gracedale crowd and Tricia Mezzacappa would be screaming the words TERRORISTIC THREAT? And how long do you think it would take them to file a police report? The answers are "at the top of their lungs" and "immediately." So cut the nonsense about Second Amendment rights, they are no more absolute than any other Constitutional rights, including the First Amendment, the Fourth Amendment and the Fifth Amendment. The fact that someone needs a license from the government to carry a concealed firearm is proof of that point.

ReplyDeleteI obtained a copy of the document filed by Tricia Mezzacappa on May 14 in response to the O'Hare defamation suit. I happen to be a lawyer. She is not, which is abundantly clear from her self-prepared mishmash of nonsense she calls "preliminary objections" followed by a "memorandum and request for special accommodations." In the document, she asked to testify "from a closed circuit TV," but she also told the court she must be sedated with controlled substances for anxiety. Then she offered her own expert opinion. "It is my opinion (as a Registered Nurse of 10 years) that due to the potency of this medication I would be unfit to stand trial or provide my own defense pro-se."

The Sheriff, in the interest of public safety, should find out what controlled substances she is taking, the "potency" of the dosages and inquire into her expert opinion that she "would be unfit to stand trial."
I know Kelly Gross. I have known her for almost 25 years. Kelly is a lady and a devoted public servant. I don't know Mezzacappa but I have read her disgusting blog. She seems petty and vulgar and obnoxious and juvenile and nutty. For Mezzacappa to say that Kelly is "obsessed" with her is as false as all the other crap she publishes. ReplyDeletePoor Tricia Mezzacappa can't find a lawyer to represent her. Some 24 lawyers have rejected her case, she says. I would like to know how Mezzacappa expects to pay a lawyer. Does she intend to barter legal services for massage services? Lawyers want to be paid a retainer fee that involves actual money. Word on the street is that her failure to pay her painter (she tried to barter with him for massages) caused the painter to report her to West Easton officials a few years ago for operating an unlawful business out of her residence. She would probably like a do-over on that fateful transaction.

You can delete words Bernie but you can't delete the fact that you and your friends are displaying behavior every bit as cray as you claim this young woman is showing. You are acting in a way consistent with someone who went through an emotional experience with someone and it soured. Give it up already.
Again, and again, "Pot meet Kettle" oh and I am not a lawyer. I am a gun rights advocate. I have seen this tactic pulled on men who went through divorce or separation by angry spouses and sometimes it works. I don't like seeing it used on anyone.

Mezzacappa said the words to the song she selected to use for her gun video "are about as incomprehensible as can be." Really. That's what she said.

Is it just a coincidence that these incomprehensible words are about using a firearm to kill people the shooter doesn't like? What's incomprehensible about "better run, better run faster than my bullet"?
There's nothing incomprehensible about those lyrics and for her to claim otherwise proves she is the one with the guilty mind.

ReplyDeleteI'm not sure what point you're trying to make, except to give a pretty good reason why she should not have a gun permit. Current law provides that LTCs should not be issued to person who present a threat to public safety. She does. This is not more gun control, but enforcement of the laws that currently exist.

Don't you have better things to do? It can't be about local taxes, otherwise you would be focusing your energy on school taxes, which take a much bigger bite out of your pocketbook. What you report is hearsay. I doubt you ever saw the wads of cash. But what someone asks of the right reverend, he can prove and shut some people up. All he has to do is provide records that demonstrate accountability and transparency.

He could have reviewed the offensive comments. He could have admitted mistakes or provided an explanation. Instead, he chose to make it all disappear. I delete anonymous personal attacks. The Fake Rev, D'Allesdandro and Schmoyer have all used this blog for that purpose, and I delete them when they do. Cowards, they do not even sign their names to their hate when they spew their venom on the Gracedale blog. They embrace Mezzacappa, a conservative R who wanted Gracedale sold, bc she hates me. She turned face and embraced their cause bc she hates me.

I never wanted to mention this, but now the cat's out of the bag. Mario Martinez' mom was apparently kept in her own private room at Gracedale. Kelly Gross' grandmother was also at Gracedale, in a nearby room. Kelly visited her three nights per week. When she would go up to see her own grandmother, Martinez' mother would see Kelly, and take her hand in two fingers, and Kelly would take her around. She liked Kelly, who has a good heart.
