Commonwealth Court Fast Tracking Gracedale Appeal

As expected, Commonwealth Court is fast tracking my appeal of Judge Barratta's validation of signatures in the Gracedale initiative. In a per curiam Order filed yesterday, I've been excused from filing a reproduced record, which will save me quite a bit of money. My brief is due by March 15. I'd expect a ruling very quickly thereafter.

  6. I would be shocked if you didnt win this one. Will your appeal and stoffa's be merged into one, or will they be heard separately? Its the exact same appeal, right?

  7. Actually, I think I just answered my question. You are appealing the signatures issue, and Stoffa's appeal deals with the Home Rule/ budget effect.....

Maybe they will both be fast tracked

  13. Prediction: DENIED/DISMISSED

Sorry 10:29 but we look for Judge Simpson to back his old pal and former colleague Judge Baratta. The otter will be doing back flips in the Susquehanna.

  14. Anon 11:56

I think you have it wrong.

More like Baratta asked Simpson's permission to take the heat away from him.

dont forget about the other 6 on that bench

  17. "Prediction: DENIED/DISMISSED"

Undeniably, it is always an uphill battle on appeal.

  18. "Maybe they will both be fast tracked"

From what I'm hearing, they both will be fast tracked.

  19. Oh Brendaaah and others, the Bernie O'Hare lawsuit will be denied/dismissed. Stoffa's might have a chance, a slim chance.

It will probably fail. This is not about the union for the people who see the value in a County Home for the elderly. Frankly we don't really have an opinion on the union or union concessions. We do know the nonsense written about private homes reads much like Bernie Madoff's investment return reports.

Point is, if Stoffa loses and he should. The minute he tries to close Gracedale or seriously impair its ability to serve the sick that are there, a judicial injunction will be slapped on the county to halt proceedings. Then the county will face a series of lawsuits by residents and family members, real attorneys are standing by.

Finally a drive for a recall vote on Mr. Stoffa will follow and be successful.

Gracedale is really not about the union for the majority of citizens who oppose its sale. For those of you who want it sold it is all about union hatred. That is why we will triumph in the end and the sacred covenet between the hardworking citizens of the county and the county government will be maintained. Hard working taxpayers, union and non-union, Republican, Democrat and Independent support Gracedale. They are the silent majority in Northampton county. They see the real politics behind the sale amd the rush to capaitilize on uninformed, inexperienced county council members votes by Angle and Stoffa. They see the truth behind the smole and mirrors of the numbers game Angle and
    Stoffa are playing.

Look at the bright side, you can go march on Harrisburg or something. All while collecting you teachers pensions, social security and disability checks.

    Sanity in Truth!!!

  20. It is people like you that make people like me look good. Your hated of Stoffa oozes with every comment and that is all that motivates you, not Gracedale or anything else.

    ReplyDelete
  21. Instead of addressing the facts you make a personal attack. Angle/Stoffa would be so proud of their little munchkin.

    ReplyDelete
  22. You're not listing any "facts." You just spew venom.

    ReplyDelete
  23. Sanity in Truth- you are INSANE! All of your scenarios are misguided at best or delusional at worst. The average NorCo taxpayer LOVES Stoffa and is getting sick and tired of union thugs trying to force their agenda on an already overburdened tax base. Pennsylvania has the 10th highest taxes in the nation. And, we have the second oldest population in the USA. Take the Gracedale money and use it to support Meals on Wheels and other senior programs that enable our elderly to licve in their own homes with dignity.

    ReplyDelete
  24. Saving Gracedale is all about saving unions and high benefits...not about patients.

    ReplyDelete
  25. No venom, just facts to refudiate the blather from the Angle/Stoffa camp.

You can't handle the truth. This is not about unions. It is about the worth and care of elderly county taxpayers.

Shame on you for hiding and trying to destroy the truth.

  26. I'd re-elect Stoffa, Angle, and the rest of the majority to close Gracedale and force Barron to care for his own granny instead of making us do it for him while he collects a taxpayer-paid salary for a job he fails to do. It's time to excise the entire leech class from our county.

    ReplyDelete
  27. Hey fella'

If anyone failed to earn their salary it was Stoffa this year

    ReplyDelete
  28. Change your grannies diaper once or twice and you'll sing a different tune

    ReplyDelete
  29. Stoffa is a lifetime governemnt employee with a multitude of public pensins. That is your anti-government worker hero?

You drinking some of O'Hare sauce?

    ReplyDelete
  30. Bernie why dont you run a poll for Gracedale on your site and see if we can get a true feeling from people?

    ReplyDelete
  31. Internet polls are notoriously inaccurate, but most people would vote to keep Gracedale in County hands. That would be my default position, too. People do not have the time to look into these matters and make an informed decision. That's what the elect others to do that.

    ReplyDelete
  32. "Stoffa is a lifetime governemnt employee with a multitude of public pensins"

Stoffa could be collecting those pensions, but opted to run for office and serve NC. You can't collect when you are working.

  33. A POLL ON HERE ?

you realize 12 people comment in here and 7 of them are Bernie
