Can Scranton City Council Amend Mayor's Budget?

This question, which is being decided in a Lackawanna County Court, has repercussions to any Home Rule Charter municipality.

  1. It may only be relevant to those home rule municipalities with the same language. I also believe that the specific language relating to the budget would control the more general provisions of the section governing when ordinances are required.

    You get a twinkie! You must be a law school grad.

    The curse of HRCs ais that there are so many varying interpretations that it will take another 100 years to litigate just some of the major issues. I'd hope that the Scranmton case could provide some guidance, but as you so astutely note, it's hard because every one of them has differences.

  3. beyond the differences in language between all the HRC's, it important to remember that PA's distinction of first class, second class (A/B), third class cities and counties all have different empowering legislation that might conflict with the HRC.

    PA local gov't... keeping lawyers busy.
