According to the Pa. Crimes Code, "A person commits the crime of harassment when, with intent to harass, annoy or alarm another, the person: ... engages in a course of conduct or repeatedly commits acts which serve no legitimate purpose."
A spam attack, on this and other blogs, is being engineered by Bill and Angie Villa. In addition to the comments I've deleted, there are now at least 350 comments on my blog alone, all of them made between 7 AM and 12:00 PM. The comments are coming too frequently, and on too many different blogs, to be Villa alone. He's getting some help from his wife.
Their course of conduct serves no legitimate purpose. It is intended to harass, annoy and alarm others.
The purpose of this post is to make Villa aware that he has committed a criminal offense. I will no longer delete his comments. I consider them evidence.

Actually, the invitation to a fight, had it unfolded, itself would have been criminal, simple assault by mutual combat, an M3. So by that reason, the invitation could be considered an attempt to enagge in simple assault, which merely requires an act in furtherance of the assault, that being his invitation. Maybe we should get Villa to bully the DA, so that the DA might trump up the charge against Villa.

I spent a few minutes researching court opinions on Lexis and it appears whomever is flooding the sites with spam-like postings could indeed be breaking the law (if the local police can be persuaded to file a criminal complaint or, if they don't, the DA's office endorses a private civilian complaint).

ReplyDeleteLast time Villa began hijacking blogs, I set up a blog specifically to deal w/ trolls. I don't consider that cruel, bullying or immature. I call it self-defense. I spent some time looking into all his conspiracy theories vis-a-vis the MC and DA Jim Martin. I found his claims to be spurious and said so. I stood up to a bully who routinely threatens other people. If that makes me immature, then so be it.
He's not used to that.
As far as Villa is concerned, his course of conduct icludes threatening physical harm, inviting me to a fistfight, and overwhelming this blog over and over with the same spurious remark, is clearly criminal harrassment. He has engaged in a repeated course of conduct in which he threatens other people, telling blogger Michael Molovinsky to cross the street and telling Ayy' Najarian that he is comong after hom with "both barrels." He has told me he'd like to brak my jaw in seven different places. All of this is in his own writing.
After his attempt to engineer a boycott of this blog failed, he embarked on a new course of conduct, flooding this blog with spam comments.
He is guilty of criminal harassment and I am doing what I need to do.

ReplyDeleteAs far as what I did is concerned, let's see. I began to delete his comments as he got more and more outrageous. I set up a troll blog after he called another lawyer dude a backstabbing weaselm pussy, incompetent attorney, etc. In that troll blog, I pretty cleary established that Volla's claims about the DA and Morning Call are completely untrue. As he continued to spiral out of control with accusation after accusation and goofy boycott demands, I laughed at his folly and pointed out his wife is an enabler.
Actually, this is a monkey who's been throwing shit all along. What I did was expose him. In fact, I would do it again. And what I did do is no defense to a charge of criminal harassment.

No Imagination - Most are frighteningly obvious; sexist comments on nurses' groups, blasphemy on religious groups Pedantic in the Extreme - Many trolls' preparation is so thorough, that while they waste time, they appear so ludicrous from the start that they elicit sympathetic mail - the danger is that once the group takes sides, the damage is done.
False Identity - Because they are cowards, trolls virtually never write over their own name, and often reveal their trolliness (and lack of imagination) in the chosen ID. As so many folk these days use false ID, this is not a strong indicator on its own!
Crossposting - Any post that is crossposted to several groups should be viewed as suspicious, particularly if unrelated or of opposing perspective. Why would someone do that?

Repetition of a question or statement is either a troll - or a pedant; either way, treatment as a troll is effective.
Missing The Point - Trolls rarely answer a direct question - they cannot, if asked to justify their twaddle - so they develop a fine line in missing the point.
Thick or Sad - Trolls are usually sad, lonely folk, with few social skills; they rarely make what most people would consider intelligent conversation. However, they frequently have an obsession with their IQ and feel the need to tell everyone. This is so frequent, that it is diagnostic! Somewhere on the web there must be an Intelligence Test for Trolls - rigged to always say "above 150"
I believe that most trolls are sad people, living their lonely lives vicariously through those they see as strong and successful.
Disrupting a stable newsgroup gives the illusion of power, just as for a few, stalking a strong person allows them to think they are strong, too.
For trolls, any response is 'recognition'; they are unable to distinguish between irritation and admiration; their ego grows directly in proportion to the response, regardless of the form or content of that response.
Trolls, rather surprisingly, dispute this, claiming that it's a game or joke; this merely confirms the diagnosis; how sad do you have to be to find such mind-numbingly trivial timewasting to be funny?
Remember that trolls are cowards; they'll usually post just enough to get an argument going, then sit back and count the responses (Yes, that's what they do!).
